bank charges

are all bank charges illegal or are some of them legal?

i want to start the ball rolling and claim back any unfair bank charges, just not sure what i should be looking out for on my bank statements.

can anyone help?

Reclaimed my bank charges - got £250 back from HSBC and £88 from First Direct :)

    You probably need to send the preliminary letter on the consumer help website asking for a list of all charges etc. I sent mine off at the beginning of the week - keeping fingers crossed it all works out.

  • Officially the time you can go back is 6 years (statute of limitations act 1982). This is from the time you realise the charges are unlawful (generally from when you request the information as a rule).

    However, if you can prove you have been mislead in certain ways the limitation act allows you to go back further. There's a thread about it on the CAG forums. I' not sure if anyone has attempted it yet but in theory it should work.

    Most people are happy to go back 6 years, but if you're interested in going back further find the CAG thread and read up on it.

    It's pretty obvious that the banks have been deliberately concealing the punitive charges which means that the SoLA becomes irrelivent and no charges are then statute barred. Because a bank won't appear in court just to defend on a technicality, let alone at all, you could easily get away with it. I'm convinced if I sued my bank again they would pay me again, because it would be cheaper and easier to pay me than defend it - even if the claim is unjust. But ssssh :)
