Money gone from my account

Its a real shame I've only just found this site because earlier in the year £1800 went missing from my account. It was not all at once but in drips and drabs so we did not notice them. One of the last withdrawals was for £150 which caught my eye and when I asked my wife she said she did not withdraw it. Straight away we called HSBC and they they told us it was my wifes card and which cash point was used. Funny enough the cash point was just round the corner. I went over and saw the had CCTV there so called the bank and told them that there was CCTV and we could probably catch the thief. I told them I was going to call the police but the lady said they have their own investigation team so just leave it with them. About 2 weeks later this guy called my wife and asked all sorts of questions, he seemed very aggressive and when he found out that on a few of the days money came out my wife was in the hospital for 2 weeks, he calmed down and apologised and said he was carrying out an investigation on my wife because her card was used with the correct pin number. She told him about the CCTV and he said they would obtain it and show her some stills to see if she knew the person. Well after about a month we heard nothing so called and and they asked my wife if she signed some documents to say she knew nothing about the missing money. She told the guy the documents were never recieved and he said not to worry the money will be put back into the account once they get the signed documents. Then another month went by and we called again only for some woman on the line to say they not going to pay back the money because they believed my wife took the money.

We then contacted the financial ombudsman who took statements from us. We kept hammering on about the fact my wife was in hospital and the CCTV would show it was not her but it all fell on deaf ears and they sided with the Bank.
I don't know any of you on here and I have no reason to lie but we know nothing about the money and we're £1800 pounds out of pocket. The only thing the bank gave us was an overdraft thats killing me with interest.

I will never again use the financial ombudsman for anything.

    so what happened about the cctv pictures, did anyone see them, if not, why not.

  • When we spoke to the financial ombudsman we told them about the CCTV and they said we should have called the police. We told them HSBC told us not to but their response was "they would have told you its not necessary but would not have told us we should not"
    When we did speak to HSBC even before the financial ombudsman they said too much time had passed for them to get the CCTV and they could not trace the person who told us not to call the police. We told the lad on the phone it was someone with an asian accent and she just said all the calls are diverted to India its only the investigation team thats in Britain.

    The argument I had with the investigations manager was the fact he kept saying the correct pin was used and the unique black strip was also showing up (his words) there is no evidence to suggest the card was cloned. Like I said I have no reason to lie, I already lost the money, I just wanted people to know the financial ombudsman is not what we think it is......... well for me anyway. I'm just a small guy with a normal current account, I guess I stood no chance against a big company like HSBC
