Child's Post Office account - are these safe from CSA new Bank arrestment laws?

The only bank account we have in our household is in my name solely. H's wages go into it. I have control over the money. He's just crap with money so I sort it. No CSA involved so not a case of trying to "hide money"

Hopefully we would never be in the position of being hounded for arrears by the CSA to the extent of bank accounts being raided ... but I wouldn't be happy if they could access my account and accuse us of having it in my name just to try and avoid them.
If you did have a CSA case ongoing though Shell and all of the money was being put into it then the PWC could apply for a variation to the order and they could investigate your bank acounts.
They had the legislation to do that long before this latest bit came in, it was designed so that NRP's could not divert funds into another account and claim they had nothing of their own.Free/impartial debt advice: Consumer Credit Counselling Service (CCCS) | National Debtline | Find your local CAB0 -

They could investigate my bank account on the PWC's word? I understand they can investigate accounts in the NRPs name.
So if the PWC piped up and said "I know the NRP is hiding his income in Fred Bloggs down the street's, bank account" would they be able to access his account as well?August GC 10th - 10th : £200 / £70.61

Don't be surprised Shell, this gov't knows everything about you and whatever they don't know they have the power to find out. We live in a surveillance society. If you dodge your responsibility towards your children you deserve to be found out - and you will be!
If you are being honest about your financial affairs, pay your CSA dues as required, but don't want an all too common CSA/CMEC all mighty c**k-up that could cost you (and your children) for years to come, I'm told that a foreigner who settles your child's trust fund is beyond all of our draconian big brother measures. Not advocating avoidance - just precaution.0 -

They would have to have some justification for it - say if the NRP was self employed and his partner was his business partner too, or in your case where the NRP was having money paid into your account as he did not have one of his own (in your case his income is easy to prove as he has pay slips).
But yes if they could justify it for example by income inconsistent with lifestyle then they could investigate your bank accounts too.Free/impartial debt advice: Consumer Credit Counselling Service (CCCS) | National Debtline | Find your local CAB0 -

But they would have to provide some evidence of this inconsistency, surely? A PWC couldn't just accuse anyone willy nilly and the CSA go off investigating people's bank accounts?
Plok, I don't know if your post was aimed at a general "you" or you meaning me, but I pay for my children. They live with me lol I am not an NRP. My husband pays his child support via a private agreement so no CSA involvement thank god.August GC 10th - 10th : £200 / £70.61

That evidence could be something as simple as evidence of a company car though being honest  The laws are there to protect the PWC but just like anything else can be open to abuse by either side.Free/impartial debt advice: Consumer Credit Counselling Service (CCCS) | National Debtline | Find your local CAB0 -

wanna bet!!
the pwc's word is taken as absolute gospel. even when you send them proof to the contrary, they still wont go against their prescious pwc clients.
stiil, good job my mp thinks otherwise! :rolleyes:NEVER ARGUE WITH AN IDIOT. THEY'LL DRAG YOU DOWN TO THEIR LEVEL AND BEAT YOU WITH EXPERIENCE.
and, please. only thank when appropriate. not to boost idiots egos.0 -

If you want to keep that money safe then I would open a trust fund for the child with an end date when they can access the money.
A solicitor has said similar, but has referred the question on child's bank account security to a barristers consultation. I'll bring the written result when I have it, which I am told will be about 7-14 days.0 -
So go find yourself a nice Mr Foreigner and your child's future prosperity will be assured.
I am exploring this route, I used to work for Credit Suisse in the 1990's and know how swiss bank accounts work & I still have one. Its safe from the CSA after discovering the CSA tried snatching money in a dormant HSBC account using its new legislation. Domestic Swiss bank accounts do not show on a credit reports because they are numbered accounts, thus, immune from CSA money snatching.
I cannot appeal against the child assessment because I am out of time. I know its wrong but there is nothing I can do except move everything to safety until the CSA decide to be more realistic in reaching a sensible resolve. Not a discussion for this thread.
The money laundering regs in Switz are the same as the UK, 2 forms of ID plus photo ID etc, but there is concern the UK may try and pass even more laws trying to obtain money held in offshore accounts.
I am seeking expert advice on this at the moment. I have asked for a written answer from a Barrister and will bring it here if there is any useful content.0
