Edwards geldards & the mortgage corp

Options
In 1992 we lost our house primarily because we lost my wifes salary due to ill health.
The press was full of ministerial advice to "tell your lender if you can't meet the payments" I told my lender the first month I couldn't meet the full payment --gues what 10 days later a writ for possession came. We had a mortgague of £48k then in a house that was valued at £37k so nobody would allow me to remortgage at £48 over a 24 year term. We had an endowment at the time. Anyhow they got the house, sold it for £37950 and came after me for £22k. when I asked for an explanation they simply said it was interest and charges. The Court was very sympathetic and because we had made a serious effort to compromise and try to fix an arrangement to keep the property they REFUSED outright to grant any costs to The Mortgage Corporation saying their behaviour was "unhelpful".

From 1992 we move on to 2002 when my wife passed away aged 46. You guessed it I was aproached by The Mortgage Corp agents for payment. I refused to pay anything, they obviously thought my wife had an "estate" and they would cash in on it. We roll on now to 2005 when I was approached by EDWARDS GELDARDS solicitors claiming to act on behalf of TMC. The firstly wanted £16k and the offered to settle at £8k suggesting I should borrow the money. I declined saying I had not anything like taht resourse and had no money to pay anything.

I was then offered a deal to Pay £1000 to settle, I asked for that in writing. In the phone call offer I was asked if my family would help me out if I couldn't "borrow" it elsewhere. I got the letter and at great embarrassment borrow from my wifes parents and my daughter.

To come to the letter and commuications. The letter states "The settlement which has been reached is in satisfaction of your liabilty under the terms of the mortgage deed". Of course I know know that this is an untruth and that after 6 years or no contact or payment the statute of Limitation ended any obligation or liabilty.

I have written to EDWARDS GELDARDS who offer a financial and mortgage service saying that they knowingly made claims that had no foundation in law and that they had withheld vital information in respect of the status of their claim. I have asked for their comments.

Has anyone come across a similar situation? And do you thing I have ground for getting my money back from them due to their spurious claim?
