Hi everyone!
I am currently being chased by NatWest for overdraft/charges. I had been waiting on the charges case to go through so had been sending letters stating that I won't be paying anything until the case is concluded. It's now been passed on.
Had a letter from Triton on Monday stating that they wanted paying within 7 days or further legal action will be taken. They have also been phoning home/partners work/mobile (I have now sent a letter stating I wanted communication by letter only, and to remove numbers.) I finally plucked up the courage to talk to them today - if only to tell them verbally that I wished to only communicate by letter. Now, the woman I spoke to did not ask for any security details (only asked if she could talk to me by name) I then jumped in and stated I wanted everything in writing and wouldn't discuss it. She then asked why I didn't want to - I repeated that I was within my legal rights to have everything in writing, she then went on to say that they would start legal proceedings on the account. I said fine and then said a rude word and hung up.
Now, does she have a legal obligation to ask for security details before saying something like that or is that ok?
I am currently working out exactly how much we can afford, ready to make an offer. Do I need to ask for proof they own the debt first?
I'm shaken now - they're such nasty people! :mad:

I know this is an obvious thing to say. but being rude to them probably won't help your case.
Remember they're just people in a call centre trying to earn some money doing a job they hate.
I used to work at a callcentre, adn teh amount of insults I got from people used to really get me depressed. It's not the operators fault they're calling you, it's just their job.
Yes, check that they definitly own the debt, you must have been given something in writing from them first before they can start legal proceedings.

Triton are absolutely horrible.
Tesco CC passed my debt onto them, when I rang in response to a nasty letter, the woman was rude and abrupt and demanded I paid in full or further legal action blah blah.
This was a debt of over 3 grand - did they really think that if I had 3 grand handy, I would've been defaulting on a £100 per month debt?!? :rotfl::rolleyes:
She refused to discuss any kind of payment plan, so I left her to 'take further legal action'.
This consisted of them passing the debt to Newmans DCA, who were polite and understanding and set up a payment plan I could afford.
Screw Triton, they are mean. I think their job is to intimidate debtors initially to scare a certain percentage into getting the money from somewhere.

Andymc29, I know I shouldn't have been rude, it's not really like me and I felt very intimidated (plus I had my baby crying and was getting agitated!) Besides, theres a way to go about things - and this woman was not at all pleasant at any point, even when I was trying my best to be polite and state the facts - I would feel guilty if she had been at least civil. (I guess I'll have to get used to nastiness!)
I have been paying an amount in every month but not enough to cover the charges /interest etc so now they are chasing me for it. (I moved to A&L when the charges got out of control so my wages no longer go in as that was making it worse.) I know I have been stupid for leaving it this long but I am willing to come up with a payment plan, I was just disputing the full amount until now.
Thanks Tritacle, I think I'll just wait and see what their next move is. It's good to hear you had an understanding DCA in the end, hopefully I'll end up with the same. It's not like I want to bury my head in the sand, I'm willing to try - it's just been difficult!
