Gross Misconduct

  • I've just got a date through for the disciplinary. I can only hope they can see I'm sincerely apologetic about the whole thing. I've emailed two people who are very good at things like this and asked them to come in with me. I guess I knew what you were all going to say and I know it myself.

It isn't clear whether or not you've been suspended?

I would have thought that if they were going to sack you that you would be suspended first. I know that they can't pre-determine the outcome of a disciplinary before the event, but surely if they thought the offence was that grave they would suspend you on full pay, then get you in for the hearing asap.

    1. This isn't gross misconduct.
    2. Although i think you deserve it, i doubt they will fire you.
  • Because of the self-cert form (which we have to fill in) it seems it does come under GM at our company.
But thanks for that.... I've explained the situation and said I am sorry, even as I was doing it I felt guilty and I've never done anything like it before or even considered it. Yes I know I did wrong but I'm admitting it so don't need you saying things like that.

  • Good luck with your disciplinary PPB. TBH, I think most of us have had a 'duvet day' and it would be a bit harsh to sack you on the spot. I assume you didn't get paid for ths day? If you did, why not offer to surrender the days wages? They may see it as theft if you were paid for it too. Sounds overboard, but you know what these people can be like!
You've come clean and are prepared to take the consequences, they can't ask for more than that. I just hope that the worst you get is a warning, I can tell it'll be the first and last time you'll ever do it!
Watch out people. You don't know what lurks around the corner for you![/SIZE]

jeez - pulling a sickie is gross misconduct!!! this means that approx three quarters of the workforce must be quaking in their boots now!
call me old-fashioned but in my day gross misconduct was theft or assault or breaking confidentiality!
hun - we have all done it! or nearly all, i suppose they may be a few who havent.
In your favour - you didnt try to weasel out of it and have sincerely apologised.
but - in calling this gross misconduct the company havent left themselves much room to be compassionate have they?
so sorry for you hun - if it was up to me you would just have had a warning! (still shaking my head over a company calling this 'gross misconduct')

Let's just say our company takes a dim view of sickness, and you can even have a disciplinary if you are sick too many times as they have a limit on how many times a normal person is sick!

your company may take a dim view of sickness - but in genuine cases they could well find themselves at a tribunal if they sack under some circumstances.

which doesnt help you at all does it?

all you can do is apologise (in writing if necessary) and promise you wont do it again. and cite stress as major factor in you acting out of character.

good luck at the hearing - you sound like a good employee otherwise and i would hope they would take that into consideration.
  • Thanks tandraig, in the meantime I've been looking at other jobs today just in case (and found one I actually really quite like anyway). All I can do is wait, and try not to worry too much!xx

  • It was not just pulling the sicky but falsifying the document. The latter being the more serious of the issues. I know you probably dont want to hear this, but I have dismissed staff for this in the past. Most have apologised, said it was the only time but it goes to the trust and relationship between employee and employer and as such your company may decide that termination of contract is the only answer.
