wrong date of birth

Out of the blue last year i answered a phone call from a company called Capquest. They informed me they were trying to collect a debt. When it came to confirm my details about this debt they said that because my date of birth didn't match the one they had ,"for legal reasons" they could not talk to me. They then asked me to supply them with my birth certificate. I didn't.
That was a year ago,now i'm getting letters threatening to take me to court.
How should i contact them further?
Can they prove the debt is mine if they have the wrong date of birth?

Hi
Do you think the debt might be yours? Do you have outstanding debts?
I'd suggest you send the prove it letter - http://forums.moneysavingexpert.com/showpost.html?p=11570893&postcount=2
And don't send you birth certificate - they have to prove you owe the money not you prove you don't. (And even if you do owe it you need to send that letter as they need to prove they have a right to collect it).
If its your debt then before you admit to it consider if it might be statute barred - http://forums.moneysavingexpert.com/showpost.html?p=11571227&postcount=3A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
You should know coz you don't mention: Do you owe this debt?
You were quite right not to give them any of your details, and in fact if any company rings you up and asks you to confirm your details then it's worth pointing out that THEY rang YOU! Data-Protection-Act their asses and see how they like it!Would you ask the wolves to look after the sheep?

They can't ask you for the details, it is upto them to verify them.
Send them the prove it letter, maybe even mention i was contacted previously over a year ago but you were then unable to prove this was my debt.

2.7 Dealings with debtors are not to be deceitful and/or unfair.
2.8 Examples of unfair practices are as follows:
j. requiring an individual to supply information to prove they are not the
debtor in question, for example, driving licences, passports, full name,
date of birth, signaturesAlthough no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0
