Asda Miss price : Are the "supposed" to honour it?

For future reference for myself more than anything.....this post relates to Asda but I guess the same query is aimed at all supermarkets :

I was just in Asda about 30 mins ago and walked past the end of an Isle where they had stocked up all but about 10 cases of Diet Coke (the unit thing was full the cases not on were not on because they wouldn't fit) and the sign above it said £1....yup 1 whole pound of a case of 15 cans of diet coke. So I popped a couple in my trolly. As I did a stacker walked past and said "I don't think there supposed to be £1 you know, I'll check) so I waited and she came back and said no £5.50 so I said "oh well, thanks" and wandered of thinking if they had to honour the price advertised I would get a good deal.

I decided I'd wander back and get a picture as proof of said incorrect price and they had taken off the £1 sign DOPE to late, 3.30am I was to tired to think quick!

At the till I asked the lady and she scanned it and said it was £5.50, I explained about the £1 thing and she said they don't have to honor it as on a night they are stocking up which means thing are getting "moved round" etc and so untill all "stocking up" is finished they don't have to honour any price miss matches, I just left it anyway as like I said I was tired....then she offered me them at £4 :confused: I didn't bother.

So basically do they (or should they) have to honour the price or is it "waved" cause there re stocking their shelves?

    no they dont have to honour the price its an invitation to treat and unless they are delibretly misleading you then they can refuse to sell you an item with no legal comeback

    however if you bought an ipod touch reduced from 169.00 to £16.99 and it scanned and you had a reciept then no matter what happened afterwards they could not then ask you to pay anything more as your contract is formed when you the offeror make the purchase

  • this has happened to me a few times in morrisons - not as big a deal as the coke was'n't' on but a few times ive picked things up thinking they were on offer and once ive got through the till they werent - and they have 'never' honoured the saving. i used to work in iceland and if anything was marked up wrong (which rarely happened) we always reduced the item and then changed the label - suppose it depends on the store.

    Its also reasonable that they didn't honour it because as you selected the items they pointed out to you that the price was incorrect and then told you the correct price, then quickly rectified the situation by changing the price above the item.

    I have had this happen several times over the years in in Waitrose. It usually happens when the offer has expired and they have not removed the SEL. They have always honoured it

    in my Asda they wont honour the price if you pay and then query with the customer services though I believe they would refund.
    However if I ask the manager about the misprice before putting in my basket, she sometimes will come to the till and tell the assistant that she has okayed it because it was wrongly marked on the shelf.

    I honestly think Morrisons do this on purpose - I was caught out a couple of times with special offer baskets, so now check that the item in the basket matches the item on the sign.....and a lot of the time it doesnt! :mad:
