Baliff help can they take car in spouses name. and how do they work out charges?

My wife today has had a visit from the bailiff JBWgroup asking for over 600 pounds for to 30 pound parking tickets (that fair enoough should of been paid before but we cant go back in time) the trouble is we are in a lot of debt already and have got into the habbit of not opening the post...

Anyway we will not let him in so he said he will come back after the weekend and take our car. My wife works as a waitress and needs the car to get to work and we use it to get our kids from scholl which is a few miles away. first question is can they still take it?

I was thinking of putting the car into my name as it is currently in my wifes who got the tickets in the first place. or put it into our friends name. if we do that can they stil take it?

and secondly I have no idea how they have got the charges from two 30 pound fines into over 600! is that a fair amout to be added by bailiffs and can anything be done about it?

I apologise for the rushed nature of this pos I hope it makes sense.:eek:

  • They can only take the car if it is in the name of the debtor, and if it is the debtor does not require it for work purposes. I.e. its not possible to use public transport to get to work. If they have and you need it, the levy on the car is invalid and you need to tell them so.

    Not sure on the letters to send them, but don't let them in the house or open the door to them.

    Those fees definately sound wrong - did you get a breakdown of what they were?

    Ask them for a breakdown of the fees, i didnt spot that in my first look through.

    £600 for a £30 fine is excessive, and OFT guidelines state

  • is the car paid for? or on HP, this will also make the levy invalid if it's not owned by you. I'm in the middle of getting my charges dropped for an invalid levy.
  • The car is in my wifes name I was thinking of getting it either putting it in my name or a friends name, but think that will propbably take too long
  • Have they posted you a levy with the cars details on it? if no levy on it, get a cheap receipt book and fill it in, even for a £1 and change the log book, as far you're concerned you've purchased the car?

    You didn't say if it was on HP or owned outright?

    Assuming the car is owned outright by your wife:
    She needs to sell it to you for a quid, with a receipt, and you need a statutory declaration from a solicitor.

    That won't take long to do, there's no reason it can't be done today if you act now and explain to the solicitor how urgent it is that its done ASAP.

  • Thanks for replies so far its much appreciated. have just phoned up the bailiffs and they say the visit which they have made (1 so far) has a charge of £200! they said i need to write if i want to know how they get there figures. is there a templlate for such a situation. sorry if im being blind and just cant see it
