PH, to ask if you could pay it off by credit card is not a problem in my book. But the way the CSA do it is to say pay it off or else, no that is a different ball game alltogeather, and very simple put is trying to get you to take out a loan with a different provider, something you cant do without a CCL.
There is no controversary about it, it is just the way that they do it is unlawful.0 -

Understood, but I also understand it from a different angle too. I have recently had a very red faced employee in my office regarding council tax arrears and I am now under obligation to deduct her earnings until her debt is paid. It is a small amount, (less than 2K) but council tax debt is considered as a priority debt, as we all know. The council took a very sharp stance and enforced payment by deo, as there is a debt. I support this, it is law. The debtor was shocked that she wasn't given further opportunity to sort it out before it got to her employer but as there was no offer of payment from the employee, it was dealt with seriously and switfly and without consideration of how this would impact on the debtor. (ie credit card loan/further debts)
To answer a question as to whether I've been personally threatened by CSA..... In the first instance, I am not the sort of person that would avoid any type of financial responsibility, so the liklihood of such a conversation ever taking place with the CSA is non-existent, so I can't empathise)Sorry to say, my conversations with the CSA have been very amicable (this is not to say that I agree with the information I've been given, that is what appeal is all about!) and is where I am at the moment.0 -
HB, I understand your point, but in my situation, the CSA stated I was compliant so it follows that I was meeting my obligation no prob. The case was then closed as they had made a compleate mess of it, and addmitted this openly. The investigation in toteh case they had no prob with and then paid out the required compensation. So where is the prob I hear you ask?
Then then re did the case and claimed arrears of a figure that seemed to me to be close to the national debt of a small country! Then the fight started and the threats followed. So it is not necessary that you have not been compliant to have this situation thrust on you. My MP has hit the roof and has written to the minister and stated that this situation can't be just or fair, the CEO's office has said he is correct in his statment and so has the minister. As my divorce left me bankrupt all the money the CSA paid me was take by the trustees so there was nothing to pay the CSA with, and they again admitted this, and said that they would write the debt of if I paid £6,000 whilst bankrupt!
I leave you to make your own decision as to if you would then fight them to the death if this happened to you.0 -
out of interest, have you ever been on the recieving end of a threatening call from the csa??
they only do it on the phone, and it's balatant bullying. when you question them and ask them to send you the said threat in writing, they make excuses and hang up. i wonder why???
when they tell you to pay the arrears off with a loan or a credit card or they'll slap a 40% deo on you or get a charging order and make you homeless, is that the same as "suggesting" you pay it with a card?? a whole world of difference.
i notice that porter's rantings have been editied out now that the FSA are investigating. i wonder what his comments will be when they confront him?? :rolleyes:
Yes had them trying to bully me on the phone .I put a written compliant in about her and also another member of staff on another matter and got £50 out of them as my compliant was partly upheld .:p0 -

people are more informed and connected with the spread of the WWW. the info to take them on is now available.
i have learnt bucket loads about how they work from sites like this.
hence my greedy, contact blocking ex now gets a fiver a week! :rolleyes:

some of the stuff she's done to my daughter and me would make your toes curl. it's hard to describe just how dispicable she is.
she's one step away from being arrested under the public order act. next time i get any carp off her, i'm having her arrested. i should have had her hauled in after the last incident but i was worried about the effect on my daughter.
