csa and ex works for company based in houston

Can any one give me advice please, Up until recently my ex and I had a minute of agreement for him to pay child maintenance to my 2 kids. He is now claiming poverty and has stopped paying. I have went to CSA but they have said that because he works abroad in Libya for a company based in Houston that I may not recieve anything!!! Is there anything else I can do?? thanks

    if he is habitually resident in the UK then, yes they can pursue him.

    you would need to prove it though.

    they cant slap a DEO on him but they can use other enforcement methods though. charging orders, ec.

    I have his address and he is not denying living in the Uk, He has threatened to move abroad but I think it is all just threats.

    The CSA said that as he works for a company registered outside UK and paying tax different( I think thats what they said) then they would not be able to deduct his earnings. Seems a bit unfair if this is the case. Will have to wait and see.

    they are correct, but they have other enforcement options.

    LOwould be first, then bailiffs, charging order on property (if owned) driving licence, passport and finally committal.

  • OP - this is a difficult situation for you to be in and I think the best thing you could do at this early stage is to write to your local MP, tell them the CSA will not persue your ex due to your stated circumstances. The MP should write to the CSA and force the CSA's hand by getting the parliamentary resolution team involved where they will have to review your case correctly. It is correct that the key to your situation is being able to prove that your ex is habitually resident in the UK. In your circumstances this should be easy to prove if he lives here. Does he own his home?

    Don't just trust some unamed case worker in your situation.
