Assuming your dilema is genuine and you've not tried the well-known classic of buying an outfit for Friday night then sending it back Monday morning for a refund....

I'd suggest you tell them that you received the goods like that (ie, stained and creased), and that the goods are clearly second hand and that is why you are returning them. If psuhed, blame their warehousing/dispatching system for sending you someone else's returned goods.

They'll not take it further, distance selling regulation and lack of culpable proof that you are not telling the truth will be difficult for them to fight this one.

As a secondary slice of advice, would suggest inspecting anything you receive mail-order, be it a dress or a video recorder by carefully unwrapping outer wrapping, etc so that if you do need to send back, it can go back in as best condition as possible.
Anger ruins joy, it steals the goodness of my mind. Forces me to say terrible things. Overcoming anger brings peace of mind, a mind without regret. If I overcome anger, I will be delightful and loved by everyone.
  • But if she ticked wrong size on the return, I am not sure you can claim this now.

My view would be to say that you tried them on and they were obviously too small. So you repacked them immediately and did not notice the mark.

The proof that you did not wear them was they were far too small.
You even tried to order a biiger size afterwards.

Then you could mention that you are unhappy being sent second hand goods if they were marked, but as you only had them out of the wrapping for thirty seconds you had not noticed.

    Good luck.
