Hi I wonder if i could have some help please, I went br in oct 2008 and was discharged oct 2009.I have been passed a letter by my father that was delivered to his house wher I have not lived for 6 years. The letter is from zinc recoveries aka ultimate credit services.it states that after investigation they have established residency at this property?it refers to a debt with welcome finance from 2003 and states that i need to agree a 1 off payment or a repayment programme to match my financial situation.Me and my partner had a secured loan taken out in early 2008 and an unsecured debt for patio doors both taken with welcome finance and prior to me taking those out i asked about the previos loan from 2003 and they could not find any record of it.The tel number wont go through to an agent and i cannot find a website also after searching the name of them i find a lot of bad publicity.should i be panicking.

Don't worry about it, GAZZA. This 'debt' - if it existed - would have been dealt with by your bankruptcy, whether you declared it, or not. I am, of course, assuming that it relates to 'unsecured' debt.
Whatever you do, do NOT try to phone Zinc Recoveries. If you need reassurance, talk to National Debtline - 0808 808 4000 or your local CAB.
There really is nothing that Zinc Recoveries can do, and if they continue to 'harass' you, report them to the OFT.
I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

You could also send this letter to them. Send it recorded delivery.

NOTICE: Pursuit of a debt included in a bankruptcy. Do not ignore this letter. You must cease collection activity IMMEDIATELY.

    Dear Sir/Madam

    Account No: *****************

You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

I would point out that the account was included in my bankruptcy which commenced on <date>.

Consequently, the debt in question is no longer my legal responsibility.

ALL contacts and claims regarding the debt MUST be addressed to the Official Receiver's Office dealing with the case.

My case was XXX of 200X, at <somewhere> County Court, and the address of the Official Receiver is below.

    <Address of the OR.
    >

A copy of the bankruptcy order is enclosed for your convenience.

Please note that the Official Receiver has requested that all future contact from your company regarding these accounts is reported and forwarded to themselves, and that continued contact with myself may result in Official Receiver taking enforcement actions against your organisation.

Please also note that we are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when the debt is not due.

In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

In addition, your continued telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office.

This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint will be submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

We await your written confirmation that this matter is now closed.

We look forward to your reply.

    Yours faithfully

  • Hi,

Out of the blue ive recieved a call from these today.

Now they are asking about a Barclays loan that is on their system, however ive never had a loan with Barclays or any dealings with them.

About 2 years ago i came home from working overseas and got phonecalls about a bank account that had defaulted with Barclays pre 2001 but i had never had any dealings with them. However i wrote to the DCA (Aktiv Kapital) and Barclays and got letters from both stating the debt was being wiped. Its never shown on my credit file and i have good credit.

About 2 weeks ago out of the blue i recieved a call from aktiv Kapital regarding this debt, i explained to them what had gone on and they said theyd look into it.

Next thing is i get this call today.

Can anyone give me any advice on how to stop these and what to do! Id also like them to mark it as statute barred or something so i wont get anymore calls or hassle its doing my head in!

    Any ideas?

    Thanks

They are less likely to pursue you if they think it will end up with them owing you!
