How much notice to give? Naughty or nice?

Hi all wonder if anyone can help?

I have been with my current company for 8 months at the end of my 6th month probationary period I had a review and they said they were very pleased with me etc etc and that a letter would come out to confirm me as a permeant member of staff.

I have never received this letter. I was also supposed to get an increase and I still haven't got that.

Anyway a mate of mine contacted me about a job at his company I went along and the short story is I have been offered a job. I am going to accept it as its more money less hours and with lots of people I know.

Anyway I would like to start early in the new year. I was just wondering how much notice I have to give my current work?

In the letter part of my contract it reads "your employment will be on a 6 month probationary period. During this period your employment maybe terminated with one weeks notice from the company. Periods of notice are set out in the statement of terms and conditions of employment" I am not sure I have these conditions of employment will have a look.

As I have not signed a contract to make me a permeant member of staff do I only have to give a weeks notice as I am working on this contract still? I am tempted to do that for a few reasons! Which I wont go into.

To complicate things my girlfriend is due on the 18th December! Work did say I could have the 2 weeks at full pay and not have to take it as holiday!! Which is very nice. But if I have handed in my notice before hand I wonder if they will even let me have the time off!? I would understand if they didnt want to pay me but I do have 10 days holiday so I would just use that but could see that might decline my holiday request!!! I could see them messing about and have a feeling they could be naughty and do something to my final pay!! I know they have done stuff like this before when people have left they have lost peoples expense and said they couldnt pay them.

I get paid on the 20th of each month so if I only had to give a weeks notice I could hand in my notice on that day without that fear. To be honest I am not the sort of person to do that sort of thing but they have really messed me about!

What can I do or what would you do?

    The question you need to ask is how important is it for you to maintain good relations with these people.

    If you've only been there 6 months are you sure you're entitled to that 10 day or is that from your annual allowance?

    Are you going to need a reference from them in the future?

    Are you sure this new venture is going to work for you/ that there is a place for you?

    How badly do you need your last weeks pay? (at Christmas?)

    If you discuss it with your manager, if he's a decent bloke, most people would understand about taking an opportunity, and if you do it now then he's got plenty of notice.

    If you don't like him or don't think he's a decent bloke word your resignation to explain the wonderful opportunity you have been given, the great time you've had with them, and thank them for being a lovely team (so on) and hand it in dead on 7 days before you need to go.

    Worst that happens is that they don't pay your last week.

    Please consider buying some pet food and giving it to your local food bank collection or animal charity. Animals aren't to blame for the cost of living crisis.
  • The 10 days is my annual leave that I have left so I am due the days off. Thing is work is so manic can see them not wanting me to have them off if they know I am leaving!

    Hadnt thought about the reference thing but hopefully I wont need one. I have a good reference from my last work where I was for 7 years.

    Not 100% sure about the future at the new job but the long term should be better there...???!!! But never know!

    I cant afford to loose a weeks pay Christmas & baby on way!!!

    What will probably happen is baby will be two weeks late and I will be due to start my new job!!

    I think my boss is reasonable but dont think the people who control the money are! :(

    Need to make my mind up this week if I am giving a months notice

  • Is the offer subject to receipt of satisfactory reference from your current employer?

    Have you received the job offer in writing?

    Do you claim expenses? If you do, make sure you keep good photocopies of every receipt.
  • Not subject to reference as I know most of the people at the new job. I have the offer contract to sign and send back.

    I sure do claiming about £400 a month expenses at the moment so I will make sure I keep a record cause dont fancy not getting paid that!

  • A lot of companies want one months notice after the probationary period. Even if they do-you give your one month notice on Monday and have about 10 days/approx two working weeks of holiday to take? So you only work another two weeks anyway! You can start the other job early or am I missing something??

    Depends what the job is I suppose but you don't owe them anything, i doubt they would hunt you down if you only gave a weeks notice?Then they would owe you the holiday pay, you don't forfeit that if you've accrued it no matter what circumstances you leave under.

    Though this may apply in your employing organisation and be included in employment contracts, there is no general legal connection between pay interval and notice period.
  • Thanks for all the replies so far.

    I think my main concern is that if I hand in my notice and if my baby is born in my notice period (likely) they will not give me the time off as I am not entitled to paternity leave, as I mentioned earlier they were going to pay me the two weeks I wanted off. But if I have handed my notice I am sure this wont still be the case!!!

    I do have over 6.5days to take not including the ones I already have booked between Christmas and new year. So I could use these 6.5 days once baby is born but I think work could deny me the holiday as will be short notice and we are very busy!! I assume they will have the right to deny me leave during my notice period as long as they pay it instead? Is that correct?

    Where as if I only give a weeks notice I can potentially avoid all the avoid potential pitfalls if I have had baby had a paternity leave and then can give them a weeks notice!

    If I knew they would give me the holiday or had to if baby was born in my notice period then I would give them a full months notice!!!

    if u are not a perment member of staff, and i asume your not as u havent had the pay rise, (tell them that when u hand in your notice) your not bound by the on month rule 2 weeks is fine!
