You could argue that his employer has acted maliciously, in such a way that was designed to undermine the trust and confidence your husband has in them as his employer. Then he could quit in response and claim unfair dismissal.
However, unless your husband has very good proof they did it deliberately, it will be very difficult to win his claim.
There's no general right to privacy in this situation. If his employer has been a bit slap-dash with their stationary there's nothing he can do. He could raise a grievance, but it's unlikely to get him anywhere.I am an employment solicitor. However, my views should not be taken to be legal advice. If he not pass on these emails there is no case to answer. Even if he had deleted the emails they would still have been 'stored' on the system, through no fault of his.0

So he's on a disciplinary because someone sent him an email and he opened it? And did nothing else with it?

Then the counter-argument exists that the employee should have taken more care when sending information like he did on email!
It's not really a counter argument, as it is a separate issue. You could, however, make it part of the same issue, by taking out a grievence. And if you take out a grievence, then any disciplinary action has to be postponed until the grievence is sorted out.I consider myself to be a male feminist. Is that allowed?0 -

the information seen through the envelope window may have been asking him to be a witness in anothers disiplinary, or to attend disaplinary training, it could have been anything, but to be honest, would anyone else be interested? maybe yes maybe no, i know i wouldnt have been interested in someone elses mail...
