If my name is on the birth certificate of a boy,and i am not sure he is mine.If i ask for a DNA test,do the csa have the right to insist that i pay maintenace for the boy.Even if i want a dna test and my ex wite refuses.

You have assumed parentage by putting your name down on the birth certificate, if you really don't think this child is yours then I suspect you will have to get legal advice regarding a DNA test.epsomdowns wrote: »If my name is on the birth certificate of a boy,and i am not sure he is mine.If i ask for a DNA test,do the csa have the right to insist that i pay maintenace for the boy.Even if i want a dna test and my ex wite refuses.*SIGH*

Have to agree - were you married to the mother? If not then you would have had to attend the registrar of births to be included so you have acknowledged the boy as your own.,
More details can be found here:

I believe if the mother refuses a test you cannot force her to take one.Free/impartial debt advice: Consumer Credit Counselling Service (CCCS) | National Debtline | Find your local CAB0 -

When can the CSA presume parentage?
We can presume that a person named as the parent of a child is the father if they:- were married to the child's mother at any time between the conception and the birth of the child (if the child has not since been adopted)
- are named as the father of a child on the child's birth certificate and the child has not been adopted since the birth certificate was completed.

She's got you by the ballsack, to put it simply.0

You could always do a test privately to show whether you are the father - for example, https://www.dna-bioscience.co.uk/service_paternity_test.php.0

If disputing parentage via the CSA, best use their DNA testing bodies. Not sure if they would acknowledge others although I could be incorrect. You could always do a test privately to show whether you are the father - for example, www.dna-bioscience.co.uk/service_paternity_test.php.

Doesn't the mother have to agree if it goes through the CSA? As she's not willing and the father's name is on the birth certificate, the CSA aren't going to be interested in making her allow one.
If he gets one done privately and he is shown to be the father, at least he will be sure that the child he is supporting is his. If the test proves otherwise, then he will have the evidence to force an official test. It will be expensive but sometimes it costs to get peace of mind.0 -

This is incorrect. You can apply to court for a declaration of parentage citing your reasons for doubting parentage the court will then make an order for a dna test.0 -

if she refuses, stop paying.
disputed parentage must be rectified before the csa have a legal case against you.
put the money aside until it is sorted in case you are the father.NEVER ARGUE WITH AN IDIOT. THEY'LL DRAG YOU DOWN TO THEIR LEVEL AND BEAT YOU WITH EXPERIENCE.
and, please. only thank when appropriate. not to boost idiots egos.0 -
Assuming the father is able to get to get the required swabs from the child, what happens if he has no contact with the child anymore.Doesn't the mother have to agree if it goes through the CSA? As she's not willing and the father's name is on the birth certificate, the CSA aren't going to be interested in making her allow one.

I do agree however if he really has doubts about the paternity of the child he needs this issue to be resolved, but he's between a rock and a hard place at the moment, he really needs to seek legal advice about the matter.*SIGH*
