help with letter of grievance please!!

I'd really like help in writing a formal letter of grievance to my employer who has refused me my old job back when returning from maternity leave. He has recently taken over the business and won't acknowledge me as an employee because I was on maternity leave. I've gone down the informal route but he won't budge. I haven't received a P45.
Any help is greatly appreciated.

    May I suggest the following:

    Dear xx

    As you are aware I have been on maternity leave, in line with legislative allowances, since xx. On xxx I tried to return to work but was advised by xx that I cannot have my old job back. In addition no offer of alternative work has been made.

    I believe I am entitled to return to my job following redundancy and would ask that this matter be reviewed urgently. In the meantime I expect to receive my full salary as I am willing to return to work but am being prevented from doing so by xx.

    If I do not hear from you within 5 working days regarding my reinstatement with no loss of service or salary, I will pursue this matter through the Employment Tribunal.

    Jazzy I think that you meant to say maternity leave rather than redundancy as the OP hasnt been made redundant..she has been treated as a non-person because she has been on maternity leave.

  • Please call ACAS asap on 08457 47 47 47.

    Seems like Direct & Indirect Discrimination as well as Victimistion pursuant to the Sex Discrimation Act 1996. Also 'Detriment' pursuant to s.47C SDA 1996.

    He cannot do this. However, if he does then he'll have to pay through the nose.

  • What has happened is totally wrong and unlawfull. I would suggest you contact a local lawyer or CAB and this matter can be rectified. Of course he won't acknowledge you, he is hoping you will go away quietly. The law is on your side in such a situation.

  • Thanks for all the advice. I'm definately not letting this one drop and have the legal ball rolling as we speak.
