Finding CSA website confusing..

Can anyone help with a question.
How is maintenance calculated. Is it by the non resident parents income alone or do they take the non residents new spouse into account as well?
Many thanks

If you're looking at new cases, or applying yourself now, it is solely on the non resident parents income and tax credits in the house. Also working tax credits in some circumstances.

Only cases on cs1 take into account the new spouse's income.

  • Thank you for that.

I have an assesment in place where my ex has paid Nil from 2002 to present day for my 2 sons with him.
my now husband and i have in the last 4 months moved 80miles away and eldest son decided he didnt want to move with us as he is in his last few month of school and will move in with us once he finishes school.
So if the ex decides he wants to try and claim from me would he have to start a new claim or would they amend the claim in place now?
I dont really understand it all as i gave up contacting them and got on with things supporting them myself when he was not paying anything.I dont work but my husband is on a low income and we get tax credits.

It would be a new case I believe.

On the CSA website, out in how much you receive a week in child and working tax credits and any income support/JSA you may receive then at the bottom click the bit where it says if either you or tour ex are on benefits as it asks. Remember to include how ever many children you have living at hhome with if, if any and approx how many nights your son will stay with you. That will give you an approx figure.

    No probs.

If you never applied for a reassessment then I don't think they would have looked into his and his wife's income again to reassess him.

As his case was CS1 it will have taken into account housing costs which will have brought down the amount he had as assessable income.
