Do you understand the concept of c&p? First off the practise must be lawful, secondly, londondulwhich is correct, agreement must be freely given by the employee, the agreement can't be coerced or sought under threat.

For custom and practice to apply one must show three basic elements (more to it than this though)...

1. it's lawful.
2. the practise is long standing
3. its notorious.

this is relevant to me and may save my job
