Permanent/Fixed Term Contracts

I'm currently on a contract at work that is fixed term (for 12 months). It's only just come to my attention recently that the job might have been advertised as permanent. A colleague who also started on the same day as me was also pointing this out (he's on fixed term too). I will raise the issue with my manager but are my employers legally allowed to change a job (if they have done that) from being permanent to fixed term?

Any sound advice is very much appreciated. Cheers.

How long was the fixed term contract for? I work for DWP and if they offer a Fixed Term appointment they put in the contract that there is a possiblity of the post being made permanent, this is because the person has been through the same open and fair competition employment as Permanet vacancies would have whereas a Casual appt can be taken on after a casual interview for a maximum of 51 weeks and can never be made Permanent.

The advertisment counts for nothing. Your contract is definitive on this matter.

12 months; I am actually working in the DWP as well. The current positions (for EOs) are stated as FT appts but with limited potential leading to being made permanent, is that what you meant? I don't understand the bit about casual appts though. I was interviewed by Manpower (with an online test before that). Also, I will ask my manager to look into this (she's already asked me to provide the IRC number so she can look the original vacancy up).

edit: Yes, DVardy, my contract is based on a "short peak in work business"...

If you have a Fixed Term contract and you applied for a Permanent job then why are you only querying this now, I can tell you for sure that no jobs advertised since April have been permanent posts in Jobcentre Plus if that helps.

There are three different types of people employed directly by DWP; permanent staff, Fixed Term Appt staff and casual staff who don't have to be employed on fair terms for example in our office we have a couple of casual staff who we got via members of staffs family/friends etc these can not be made permanent at any stage of thier employment.
