Hi,
I haven't been on here for a while but now a massive problem as occured !
I was working for an agency and was at this "company" for two months (on a six month contract). During this time I accumlated roughly three compasnate leave (my father was seriously ill, my boiler blew up and aunty was diagonised with cancer !). I spoke with the "company" regarding these and stressed, that I did not want to lose the job and therefore I apoligized for having to take time off due to these. The "company" was happy and seemed fine regarding this.
Recently though I got diagnoised with a medical condition, I was in utter pain and could not even get out of bed, the doctor had to come to my propertity to see me and suggested I should stay off work. I was off for two days sick (so thats five now in total), each time i had the curtosy to ring the agency and tell them I could not attend work and also speak to the "company" and tell them.
When I spoke to the "company" I received mixed comments, sometimes they where fine and other times they were questioning my illness stating that they where unhappy and will be speaking to the agency. In fear of losing my job, I pounded my system full of painkillers and other tablets for my condition and tried to go to work. When I went into work (after unable to gain access) there was a e-mail from management stating I was no longer employed as they had cancelled the contract with my agency. I had no contact from the agency or "company" regarding this other then the e-mail.
Where do I stand with this now?
What can I claim?
I have recently just got myself private accomadation (who accept housing benefit!) and obviously have bills to pay but am worried as hell now....
Thank you for the response in advance.

P.S sorry about spelling mistakes they are the last of my worrys at the moment...0 -
I doubt you can claim anything to be honest. I think that's one of the things you have to face as a temp. It's unfortunate for you as it does sound like you really tried to do the right thing but they're probably paying a lot for you (when I was earning £10 ph as a receptionist the company were paying £16+VAT) and they want someone they can rely on. When you're in a permanent job managers may exercise more discretion as they're investing in your goodwill.
Sorry that's not a nice fluffy answer. I do hope you manage to find another job. If you do want to pursue legal routes you need to establish whether you were an employee, or self-employed etc.0 -
Unfortunately there's nothing you can do as a temporary. If the company have declined your services that's the end of it. Get down to the Jobcentre and start a claim asap0

I have spoken with the agency now and can confirm that is what they have said in reality. HOWEVER a e-mail was sent to all staff before I was told that my contract had been ended which in turn now has been deemed as unprofessional and therefore I am going to speak to CAB regarding this.
The agency has apoligized for this and is 100% behind me in the fact I was a reliable employee (even though it sounds as though I wasn't). The agency are seeking some sort of compenstation for this unprofessional behavour.
Now I am classed as unemployed what can I claim and what realistic will i recieve ?
My doctor has now signed me off working for at least two weeks.

I believe that as you are not able to work and are not actively seeking work you will only be able to claim for SSP0

3 days compassionate leave in 2 months for the reasons you stated is enough to be terminated on its own.
Of them all the father at a push is acceptablee and only if we are talking on the verges of being dead.0 -
I'm not sure that having Boiler problems could be classed as compassionate leave, the father definatly and the Aunt depends on the companies policy.
but If I am correct you have had 5 days of in 2 months or roughly 5 days in 42 working days so nearly an 1/8th of the time and to any company that is not reliable (I apologise if my figures are wrong)

Thats a bit harsh... not going to go in why that is so harsh but it is. If thats a company's policy these days then who am I to argue, Am a firm beleiver of what goes around comes around.
To find out in the space of two months that father was on death bed then a close aunty is diagonised with cancer, would be enough to send someone round the bend. The boiler issue new propertity (rented), boiler leaking everywhere, unable to stop leak except turn of the mains, effecting the propertity where carpets and kitchen flooring is going to be effected. I think in that circumstance considering I live on my own I had no other choice.
I understand where you are coming from then and fair enough, if I was in a perminate job, I wouldn't be here now asking for advise. As I was a temp again I had no leg to stand on so realistically maybe I should of attended and been more professional, but in my life and my point of view, family comes first, I could of been a very poor member of staff, not informing them I was not coming in amongst other things, I was polite and always kept agency and "company" upto date as any other perminate staff would of done.
So off topic now as I can't turn back time and what has happened has happened where do I stand on regards to benefits. I am currently seeking the following :-
Housing Benefit
Council Tax Benefit
ESA (unsure of amount)
Is there anything I may be able to claim, again I live on my own.
