CSA miscalculation. again

Hi all,
if anyone can help me on this..
arrears... CSA miscalculated payments 2 years ago and now demanding arrears of £900...but it was their fault???
has anyone been in this situation and what did you do?


my husband is NRP, paying to CSA for 2 children since 2003. In 2005, his ex has put their eldest child into care (full time). Hubby still was paying for both of them for over a year. CSA said that its wrong and he should be paying for only one and adjusted monthly payments. They also said that he might be able to claim his o/payment back. But some time after they rang and said no, we cant give you your £ back.
any suggestions please? is it worth trying to claim it back from them? (I mean CSA..we wouldnt want to claim it back from ex directly, obviously it would afect child and we dont want that...)

    It depends on who told the CSA that the child was in care, and from what date.

    Hi - you have my sympathy!

    Where have the arrears come from? Is it a separate issue from the overpayment for the child in care?

    kelloggs36, no one actually told CSA about child put into care, it just came up in telephone conversation, when my husband spoken to them about smth else...so the CSA guy said, oh, really, you child has been put into care? then you shoul stop paying for her to your ex wife. So then a week later he send a new letter with a new (a bit less) figure. also, as i said he mentioned a refund, but then they said no..

    yeah, its separate issue, in the letter they say there is a shortfall in his payments from 2004 and he shoud have been paying more, so now he owes them 940£...so all this years they been sending us letters (and to his employer) with one figure, where actually it should have been another..We asked for a clerical breakdown which they sent, now its says 980£ on it (yet another amount owing??)..But it doesnt show any details of HOW and on which wages amounts they calcalating it...its just a simple list with moth and amounts they think he should have been paying.

    his wages depend on overtime, sometimes its quite high, sometimes it nothing and pay falls even less than 800 (3-4 month a year).
    I tried yo use a calculator on CSA website, but it asks for a NI amount yearly and his p60 hasnt got it...

    Assessments are usually only calculated on the last 5 weeks wages/2 months salary - it can change especially if you appeal the assessment at the time due to income being erratic over a year.

    To work out NI paid - go to entitledto.com, there is a page there that will give you the opportunity to input gross pay and it will work out NI.

    It sounds like this matter will turn on when informatiuon was sent to the CSA and the 'effective date'. You can also look in to the fact that it is an offence to give false information to the Sec of State, this will then lead to an investigation by the Criminal Cpmpliance Team, they 'Should' look into it and then bring the necessary charges against the person that has given false information. However if it is found that the person that has given the information is the PWC, then nothing will happen! I make no judgment and leave you to make your own!

    The PWC hasn't given false information - they omitted to provide relevant information which should happen!!!!!
