Pls bear with me, legal advice required. If a court order was made to pay mortgage arrears of £5000.00 at £200.00 per month plus normal monthly payments, then the arrears were paid off in full within a month, then due to the economic down turn within 16 months we were back in arrears and the mortgage company are seeking a warrant for possesion with out us being able to go back to court to explain, using the old paid in full court order. Were do we stand. Legal advice pls.

they can still come at you with the original possession order.. what the courts always fail to tell you is that once you paid the arrears as per the agreement you then have to get the possession order set aside/removed. there is a fee for this. I dont think you will be able to do it now as they have already commenced proceedings under the same notice.. best thing to do is go back to court - make another agreement - then make sure you remove the original order..
i've put a pretty simplistic explanation of it here but its pretty accurate..
the courts give you zero information when you are trying to navigate the legal process.. but trust me you rarely need proper paid for legal advice if you have got half a brain, a good few law books and the internet0
