help needed brian carter and bailiffs

hi sorry if im posting on the wrong board but i couldnt find the right one,i am in a right panic,
i have just received a letter from brian carter solicitors sayinf they are going to instruct a county court bailiff to call on me,all for a debt of £673 i am sat here in tears and dont know what to do i have had a mini stroke 3weeks ago and i dont need this stress,i will type out what the letter says,hope someone can advise me please,

as you will be aware we have issed proceedings in respect of this outstanding debt and have obtasined judgment against you and the next step is for us to instruct a county court bailiff to call on you.

the court fees and court costs for issuing a warrant are £72.75 and the warrant itself will be not less than £100.00 meaning that if a warrant is issued you wil have to pay the bailiff a minimum of £172.75 to dtop him taking away your possessions such as your tv or computer to pay for the debt.

the reason for writing to you now is to give you one last chance to reach an agreement with us before wwe take this action,

we enclose a payment cad which you can use to make payments free of charge at the post office,
no further action will be taken for the next 10 days to give you a chance to use the card to make a payment.


thing is i havnt been issued with a ccj as i had it stopped by phoning them up and paying them £20 in a panic this was back in february and ive heard nothing untill today,i dont want to ring them as my voice is still slow due to my stroke and i know for a fact i will burst out crying like i am now, what should i do?

    There are two things here.

    1. They may have still gone for the CCJ, so you need to check.
    2. MAking threats to people who are vunerable is not OK with the OFT.

    Given your situation I would strongly advise that you speak to Christians Against Poverty; they do home visits and can deal with Byram Carter for you. Most importantly they will advise BC that you are unwell and that they must stop harassing you.

    Please can you help us with few things.

    Firstly, what was this debt for originally?
    Secondly, when you got the court papers through, did you respond to them?

  • hi thankyou for your reply the original debt was from a catalogue and i did not get any court papers through all i got was a letter back in february saying they would send bailiffs so i rang them in a panic and paid them £20 there and then,well the situation is under control now,after i had calmed down that day i took a big deep breath and rang them and agreed a monthly payment of £7 a month which i am sticking to.things dont seem so bad after a good nights sleep,thankyou for your help kind regards michelle........x

    If you got no court papers, it is a threat and probably a lie.

    They must allow you to defend yourself in court, so if they somehow have a judgement against you and you didn't get any notice of the case....the court will set it aside.

    Bailliffs can't do a thing...don't let them in if they come. Not even for a pee. They can't force entry and can't involve the police.

    This has scared you. It was probably intended to.
    Don't be scared. There is nothing that can happen to your home or belongings.

    Things aren't as black as they muct seem. Chill a little and all will be fine.

    You aren't dealing with fines of taxman...so you're safe. ;)

    Never speak over the phone always in writting, ask for the court ref number and which court, more than likely if they have been from the bulk processing center. In which case you could apply to the court to have it set aside.
