deduction from benifits

my ex has ignored the csa letters and hung up on them every time they rang him, but they found out he is on some sort of benefit. I assume jsa.

So they said they are going to organise a deduction from benefit, how long does this take? Its already been about 10 weeks.

Also what happens if he ever gets a job, and he wont talk to the csa and tell them what he earns?

  • I can only give you my experience. My ex was taken to court by the CSA for non-payment. By the time the court date came round, he was unemployed and was ordered to pay £5 a week from his benefits. This was the last week in November. I didn't receive anything until the end of February.

    I received payments in February, March, April and May. When no payment arrived for June or July, I contacted the CSA to find out why. He hadn't contacted them, but could see from cross referencing records that he was working from the end of May and had applied for WTC at the end of June. I had to keep on at them, but eventually, after a year, they traced my ex's employer and made a DEO for regular maintenance and arrears.

    So in answer to your questions, I would keep contacting the CSA until you start to receive payments. If your payments stop, ring the CSA to ask why. Keep on at them and ask if they can check through his NI number if he has started work - they can trace his employers, even if it does take time. You would then be entitled to arrears if they have built up.

    Thanks I tried to ring them today and was given 5 diffrent numbers to ring the last one being stockport but noone is answering there I was also given a number for Bolton but when I ring it just says number not recognised.

    I guess I will just keep trying

    If its JSA he is on then yes its just £5 per week they can deduct from it, they take it off before he gets the money so he cant get away with the £5. Although if he is anything like my ex then as soon as he got a letter saying csa are decucting £5 per week from his jsa then he came off it so he wouldnt have to give me a meesly £20 per month!
