These newsletters and updates from large firms of solicitors are really useful and informative but it is worth remembering that their clients are mainly employers.
So if a new case comes along that raises a potential grey area they are going to highlight it, as this means that their clients are more likely to seek advice, before doing something that might come back and bite them.

Yes, there was a recent EU ruling.
If you fall ill before your holiday starts, you can self-certificate up to the usual 5 days or whatever even if it goes into your holiday, and get a doctor's note for any longer period.
If you fall ill during your holiday, you must produce a doctor's certificate for proof to get your holiday entitlement back. You can't self-certificate.

I took a week off work sick but I had the Friday of that week booked as annual leave. When I returned my work told me they were giving me the day back to take another time. I did have a doctors note but they didn't want it as they said I could self-certify.

I'm hoping someone can help with a query.
Hypothetically speaking if someone has annual leave booked but ends up on sick leave which overlaps the annual leave does the person lose their holiday day or can they take them again at a later date?

If you become ill during your holiday, there is no automatic right to convert your holiday to sick leave, although your employer may take a sympathetic approach. You will have to provide medical certificates as required.
the question is why would you want to convert it to sick leave when you most likely would not get paid for that but would get paid for the booked holidays. the way things have been done were i have worked is the holidays stay as holidays and its just unfortunate that you spend some of your holiday ill. i actually think even though you are genuinely ill it can give a bad impression if you take the few days leading upto when a holiday starts off sick. why? because it can give the impression that you are just trying to extend your holiday. the same logic applies if you had the first few days after your holiday off sick.0 -
In our company if you have a doctor's note you can claim the holidays back. Not sure if that's law or just a concession, though.

A lot of companies do pay sick leave - but of course if you work for a crap company that doesn't then yes, you may well choose to take the time as annual leave and therefore get paid for it.0 -

yeah, i've worked for one company that still paid us for being off sick but that was a big multinational/reputable company. i suspect most companies dont pay for being off sick. anyway i think a company that does pay for being off sick would not want you asking them if your booked holidays can be classed as being off sick instead because that would mean you would have the ability to have more time off later. companies arent that stupid.0
