hi everybody just had a letter this morning from the o.r.officially to say that on the grounds of my disability i can now keep my car.this is good however always the natterer does this mean that after 2 months since declaring b.r.at court,they are now only starting to look into our case.thanks penny always waiting for the bomb shell!!!!

Hi Penny, When the OR is appointed at the start they are receiver and manager of your case which means they can start investigating and securing assets but not actually dealing with the asset. Whithin 8 weeks a report to creditors and a notice of no meeting is sent out (if there is not going to be a private IP) and this is the point when the OR becomes trustee. Then the OR can sell or exempt assets. Don't mean to hijack this thread but does it always take a couple on months before you get your exemption letter about the car. I had my OR interview a couple of weeks ago and was told during it that the examiner had to speak to his boss about my car exemption. He then phoned me back later in the day to say that the car would be exempt. I emailed asking for confirmation of this and was told I would get a letter from the administration department to confirm it. I haven't got the letter yet and don't want to "pester" the OR's office but is this usual to have to wait the 8 weeks until you get the exemption letter ?.Bankrupt 07/10/2009

Not always, the OR could send the notices and become trustee at any point in the first weeks, but it should not take longer than that. As he phoned me back and told me it would be exempt can I take this as 100% fact ? or has anyone experienced being told their car was exempt on the phone to then be told it wasn't ?

hi debt info the car is good news for us.however does it also mean they will now begin to look into all that we have done,an what we spent now? penny0

they will have been doing that from the moment they got your SOA, usually by now the initial report will have been submited by the examiner to the OR.
Then 3 things can happen
1) close the investigation and just deal with the administration
2) sugest to the OR that further information is being sought.
3) ask the OR to put it through for immediate further investigation with a view to obtaining a BRO/UHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.
