urgent advice needed

Firstly I'm sorry if I've posted in the wrong place, been here before and it's amazing how many great people are their to help.

My problem is that I am in the final stages of petitioning for bankruptcy meaning I have all the forms filled in online with the help of c.a.b and just trying to get the money together to go to court because I am unemployed.

I am now getting letters from collection agencies one inparticular came today from metropolitan which I know is really hsbc. Anyway it basically says that I have to phone and pay or they will instruct a solicitor to apply for a warrant of execution. My debts are unsecured and I am living with my parents so have no assets. I am aware that they are just trying to scare me to some extent. But I would just like some advice on what exactly to do? I don't want people turning up at my parents door!
Do I ignore?
Or do I write and tell them I am going to become bankrupt?

I really can't wait for the day I walk out of court debt free and I can start again!

I would be greatful for any advice.

Mark

    Hi Mark,

It depends on when you are planning to go to court. If soon, I'd just ignore it and when/if they turn up, you can show them your BR order with a big grin on your face.

If not soon, I suggest you ring them and say you're seeking help from CCCS and NDL, and that they'll hear from you in a few weeks with repayment proposals. That should stave them off for a while.

    Cheers!

It will take several months before they could get a warrent, they have to get a ccj first, and the judge should give you the opportunity to make reduced payments first. If you can get the bakruptcy money together in the next few months i would just ignore them

Hi everyone thanks for your quick replies

Well I'm hoping to do it just before or just after xmas. I almost have the money but I dont want to use every penny I have just before xmas. I know I have some work coming up in the next few weeks so ideally I just want a few quid to live off and the money to go to court. So basically it will be before the end of Jan no matter what

if you're lookng at the end of January at the latest to go br then as debtinfo says they haven't got enough time to get it through the courts themselves. just have to hold tight. good luck x

If you do receiver the 'blue' CCJ papers be sure to send back the Acknowledgement of Service saying that you intend to dispute the whole amount - this will give you further time to get going on your bankruptcy. You don't want a CCJ this close to BR.

    Hi

What happens if I do get a ccj before I go bankrupt? I keep getting a call from a collection company asking if I have the money how far am I off going to court is this related?

On a seperate note does anyone know anything about contracts with credit companies? By that I mean my financial agreement is with sat barclays nobody else, so how can a collection company enforce anything when I have no direct agreement with them.

    Thanks again everyone
