CCJ on CRF

I have a couple of CCJ's on my file from before my bankruptcy, they were included in the BRO but have not been updated on the file. I am struggling to find a way to get this sorted as everything seems to be arranged around having defaults set correctly.

Have spoken to one of the solicitors who issued the first CCJ and they are being less than helpful. I guess there is nothing in it for them so why should they bother.

Can I have a certificate of satisfaction for these CCJ's as they were included in the BRO? It seems the only way to get the Registry Trust to set them as satisfied. If I can do this how on earth do I compel a law firm to do anything?

Thanks

Simon

  • I am afraid CRF clean ups are not my thing.

I am assuming that you have followed Fermi's advice on the sticky and written to the creditors Data Controller. I think the next step will be contacting the ICO.

Hopefully some one can give you some better advice later.

  • Yeah I have been through that but it appears to relate only to defaults. As the defaulted debt has been marked as satisfied and zero balanced, the CCJ has been issued by a solicitor who is not interested in talking to me at all.

The CCJ would have been issued by the court not the solicitor.

CCJs don't work the same way as defaults I'm afraid.

Last time I checked, the courts told me that you could try to get it marked as satisfied, but if the creditor/claimant would not play ball and confirm it settled then they couldn't do it.

    Daft, I know.

May be worth you checking with the court all the same. You never know. ;)

What if the CCJ was granted after BR date?

In that case the CCJ should not have been made, if the court had known there was a BR order in place.

I suppose the first thing to do is have a word with the OR. I think for a few people in the past they have sorted it and had it removed. Otherwise, talk to the court.

Got to be some way to sort it without stumping up a "set-aside" fee.
