Fieldcall

Has anyone heard of or had dealings with the above? Just got in and there was hand delivered letter saying they had called at my home on behalf of EGG. The letter states he is a "debt counsellor" and wishes to speak to me about my EGG account. It then says please telephone me within 24 hours to make an appointment. We are due to BR in just under 2 weeks, should I call them or just ignore it? To be honest it has unsettled me as I did not expect anyone to call at the house.

No expert dojo but if it was me i'd hold off, no one can enter your home at all, just don't let them in. It would take more than 2 weeks to get any kind of court order etc. It's going to be unnervy for you but you can see the end. Hang in there mate. What do you think people, just igore yeah? Just like a phone caller just knocking at your door? Just don't let him in, has no rights to enter your home or take anything. National debtline told me this. Hold your nerve hun, won't be long x

I would just ignore it. If you going BR there is nothing to discuss. ;)

You could print out a copy of the "no doorstep caller" letter to hand to him if he comes back I suppose.

Thanks for the quick replies, really appreciate it. What really annoys me is that I informed all my creditors of my pending BR, maybe I should not have done that and just kept them in the dark.

Hi Fermi, is there a template for the letter you suggest?

    Dear xxxx

    Account Ref xxxx

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.

Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    Yours faithfully/sincerely,
    Adjust as appropriate.

That is, dojoman, as your situation shows, often the best option.

However, you should be aware that, as a 'doorstep collector' the Fieldcall agent will have very few powers in law. You are not obliged to make an appointment and, should they call without prior agreement you are not obliged to let them into your house. They should not infer that they have any powers, such as siezure of goods, and you are under no obligation to discuss your EGG account with them. Equally they must leave immediately, when you ask them to:

    hi dojoman
hope you're ok...i'd agree with the others and ignore it if you can...you're so close to your br....i can't imagine anyone will be back out in the next few days anyway...
it would certainly unsettle me as well, just hang on in there though, not long to go, and remember they've got no powers to do anything...x

An alternative would be to call them up and make an appointment for three weeks time. Tell them you get paid in three weeks.

At least they will stay out of your way until then. And when they do arrive, deny all knowledge about an appointment and shove a copy of your BR order into his (her) hands.

dojoman......now is the time for you to shrug off the financial past...you have made your decisions, and plans.....so you also need to change your attitude towards these people.

You have [wisely] started your ball rolling, so put these debt worries behind you, and move on....treat such callers with the same disdain you would offer to any doorstep salesperson.

They have no rights or powers over you or your finances anymore....

what you are seeing is a desperate attempt to try and squeeze something out of you..to 'frighten' you ...in the NICEST possible way, of course....

Start to carry on with your life as normal....there is no need to hide, or to worry, it's all bluster.

In a couple of weeks time the sun will start to shine again......
No, I don't think all other drivers are idiots......but some are determined to change my mind.......

Hi dojoman, in my experience (of several hand delivered letters) I would hold back and sit tight. None of mine came back to me at any point over the 3 or so months pre br.
Good luck, you will be fine ;)
