Hi was wondering if anybody could give me some advice.
i opened a business with a friend a several years back, i left the business a couple of years ago as we had a falling out. i took my name off as secretary and director, however i didn't take my name off the HSBC business account which was in £4000 overdraft, which i now realise was a big mistake.
i have recently found out that the business has gone bust and the hsbc account has been closed down, subsequently i have been sent several letters asking for the payment of £4000 by HSBC themselves and now DG Solicitors. i have spent spent the past few weeks phoning HSBC via the telephone and in branch requesting to get the original aggreement to be sent as i do not remember whether i put down my self as personal guarantee (or my ex business partner for that matter) however i have been fobbed off by all. Telephone staff tell me that they cannot access any info on account as it has been closed and send to debt collection, whereas branch staff have told me to phone debt collection who also refuse to give me anything and they also suggested that i go back to the branch that i opened the account as they may hold it (which is tricky as i dont live in that town anymore).
Can anybody advise me on how i can get this agreement? As i have read somewhere that without this agreement i am not liable to pay. in addition i have not had anything to do with company for over 2 years, yet i understand i am still liable to pay? Would it be worthwhile getting a solicitor involved or is that a pointless exercise and would HSBC even take my absence into account?
Furthermore, the company was a limited company, so are we still personally liable?
Cheers for the help in advance!!
