Seperation Splitting Equity

Ok not really sure where to put this, but after a bit of advice.
My girlfriend seperated with her partner 2.5 years ago and they are just getting around to sorting the equity in the property, there isn't masses of money it, but just wanting some advice.
We sent a letter that basically said he was due nothing, his share of the equity less the adjustment of 50% of the capital payments paid by my g/f means he isn't due anything.
He has been paying £305 into a joint account that the mortgage comes from, this was a private agreement for child maintenance, he recently stopped paying this and froze the joint account, my g/f has contacted the CSA, got a deductions of earning, and that is now being taken from his wages.
His solicitor is claiming that the £305 was to pay for his share of the mortgage, what would we require to prove this is not the case?
