Hi Nid took your advice and sent copies of your letter how to remove a default notice to all 3 Cra regarding the default notices against me i also sent copies of letters i recieved from the companies saying they were unable to enforce the debt ect...
At the moment i have only had a response from equifax but there letter says they will not remove these and they will stay for the six years as they are valid defaults, even if no true credit agreement was recieved from myself and all i can do is put a notice of correction onto my account! wil i be able to fight this furthur with the Cra's?

    Hiya

As per the template itself, you are threatening the CRA with Libel for posting inaccurate data about you. However, the recent court case that allowed a lender (RBS) to post data to the CRA's may be making them take this approach.

The only thing you could do to enforce removal is what the letter suggests, court action. Its not worth it IMO.

You have to remember the CRA's and the lenders presume you'll not go as far as court so tend to do what they like. Regards to the 12 test cases and manchester, MBNA threw the towel in the day before court which is the usual approach. Therefore i'd hold fire for a few weeks - do nothing - until hopefully some clarity has been set with regards to this, via the 12 test cases (ongoing this week) :D
