Argos passed debt to Moorcroft

Hi,

I have an Argos card, credit limit £350, previous balance £210. I had been paying minimum payments by DD, but have just got a letter from Moorcroft advising that Argos have passed the debt on to them. Having checked with my online banking Argos haven't attempted to take a payment since June. The DD is still on my list, and I've not cancelled it.

Can I phone Argos and refuse to pay through Moorcroft? I would rather just pay Argos the arrears and find out why they haven't been taking the payments, then I can phone up to make monthly payments from now on, knowing DDs appear to mean nothing to them!

    Was it definitely a direct debit and not a standing order? This will show which party is at fault (provided you had the funds in your account on the due date).

    Sometimes companies pass this kind of debt to DCAs when people are making minimum payments, to do with the length of time you are taking to pay it off.

    As you have 'failed' to stick to a repayment agreement it might be worth seeing if it will affect your credit rating.

    If you do choose to pay Argos rather than Moorcroft you might have a bit of a battle on your hands, involving sending proof of all payments you send to Argos/proof that they should not be collecting this!

    I was hoping I could reason with Argos, wouldn't they rather have me settle the full amount over a reasonable amount of time, I can stretch the budget to have them paid in 4 months, than have a DCA buy it off them for some low percentage and let them make the profit?

    I would certainly try to talking to argos and reasoning with them, explain they are at fault but that you want the account to remain with them.
    It will probably depend on whether the debt has actually been sold on or if moorcroft are just collecting on their behalf.

    Did argos send any letters warning the account was in debit and would be passed to a DCA if not paid?

  • No, that's the confusing thing, I've not had a thing from them... Come to think of it I've not even had a statement off them in months either! Debating whether to phone or send a letter at this stage.
  • got things sorted with argos, apparantely there was an "issue" with their "system" that caused direct debits to stop being taken, and they just hadn't got round to calling me about it!

    i have now paid this debt off in full, along with several others. the argos account is showing as a default on my credit report, can i force them to remove it, considering it was the failure of their system that partially caused the account to go into default (although i know i should have been checking my bank to ensure the payment was taken, they are not totally blameless)

    also, i have 2 other credit accounts that are not showing at all on my credit report, one of which is settled and account closed last month, and the other balance was paid in full, and just waiting for a zero balance statement to close account. anyone know of any reason why?

    The DPA requires them to correct incorrect data they hold about you.

    There's three credit agencies all with potentially different data depending on which the bank decides to report information to, sometimes they may not report information at all. Did you get a credit report from all three?
