i recieved a letter at the start of feb 06 stating i owed £227 to something called a Duet card?
so i spoke to them told them that i had no idea what they were going on about. after going back and forward a few times i told him to prove the debt was mine and wanted a signed copy of the CCA.
But ever since feb i have been getting letters ever 14day telling me they have put the account on hold because at this time they can not provide what i have asked for.
But the thing is we are in june now how long can they keep doing this for?
surly if they have nothing in 4 months there is no CCA well i know there is not but when will they give up.

Sounds a bit dodgy to me - are you sure this isnt a scam?
Maybe you could ask trading standards to help you find out who they are? and even if they exist maybe you could threaten them with reporting to trading (or financial?) standards authority as they are harrasing you without providing adequate explanation?0 -
Duet as I recall could be used in various clothing stores - dorothy perkins, burton, top shop, evans, etc.

i would suggest you write to them (recorded delivery of course) saying you have enterd no agreement and demanding a copy of the alleged credit agreement and a statement of account that they are obliged to provide under the consumer credit act 1974. you should enclose a postal order for £1 which is the statutory fee. you may wish to remind them that it is a criminal offence for them not to provide the doumentation.

Maka - a Duet card if it's what I'm thinking of is a storecard which you can use in a number of different clothing/footwear shops. I used to have one in my student days, I was signed up for mine in a branch of Warehouse (a woman's clothing shop chain); however it is useable (?) in many other stores as well.
Agree what they are saying every 14 days sounds rather dodgy - may be worth contacting them again to query what action they are actually taking in order to provide proof that the debt is indeed yrs?Dealing with my debts!Currently overpaying Virgin cc -balance Jan 2010 @ 1985.65Now @ 703.63

I would contest this strongly. When I recently went through my credit report I had a duet card registered on my name, with an incorrect date of birth and no balance but a £200 credit limit. I don't remember ever taking it out.
I phoned them to cancel it but couldn't really find any details so I disputed it with Equifax. A Month later they came back to me saying that the debt was not recognised and was being removed from my details so there is a chance that whoever this is has either a lax vetting process or not very good paperwork.
Send the following letter (taken from https://www.debthelpuk.co.uk) and ignore any demands that they send you. They cannot do anything until they give you the correct paperwork to prove this is yours and they know it. They are just very well known for frightening people into payment when they don't know their rights.
Copy of letter to use if debt has been purchased by a debt-buyer. Enclose a £1 postal order in payment of the statutory fee and send by Recorded Delivery. They have 12 (working) days to respond. If they don't supply it within 30 days, they've committed a criminal offence. Report them to your local Trading Standards office.
Quote:I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx.
2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.
As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.0 -
I have a JJB Sportscard which is a DUET card. On the back is an address stating it is issued by Creation Financial Services Ltd, Radcliffe House, Blenheim Court, West Midlands B91 2AA Tel: 0870 5910 026 (yes one of those numbers!!!) Don't know if they'd be able to help further. On another note altogether I've just noticed it's expired and they haven'y sent me another one, probably 'cause I've not used it. Will they have closed my account automatically?0

I doubt it, I had to close another store card recently which had been sitting dormant for a couple of years. I had never had a statement but it shows as an available line of credit on your credit reports so it's worth shutting down for your own benefit0
