OR asking me to sign a consent form to CCCC and ND

Hello, I just received a letter from OR ..."find attached two consent forms to sign which will allow to contact CCCS and National Debtline to confirm the details of your proposal to your creditors.

However, the actual forms read ....I, (name) give my consent that the OR .....be allowed access to information held by (CCCS / ND) relating to my financial situation.

This seems to be consent to them accessing all my dealings with CCCS/ ND, not just the particular they mention. Both pre and post BR I have had a lot of contact with these advisors.

I have tried phoning OR but cannot get through. They obviously are not happy about something, but I don't think they will tell me precisely what - I have given them these details (re agreements with creditors) after a previous letter.

Anyhow, I did get through to National Debtline and explained the above. They informed me that if they receive such a consent form, even if signed by me, from the OR they would not give out any details. They might acknowledge that I have had contact with them, but " if they want any information that badly, they can take us to court!" I am still trying to contact CCCS to see what their policy is.

I have been fully co-operative with OR, have had in person interview, after which "should not be any problems...." they said.

I am not trying to conceal anything, but they seem to keep digging about - if they would tell me what they want , I would give th information, even if it might not look good for me.

Anyway the main reason for the post is just to see if anyone else has had this, and to also reassure anyone that the National Debtline at least do seem to honour their confidentiality policy.

But surely the OR should know this - that the consent form will not produce any results ? Or am I getting paranoid and thinking they are trying to test my credibility ?
Whatever, I will sign the form and send it back to them. Just wondered if the info might be useful to anyone, or if you have any comment.

Finally another general big thanks to everyone for helping to get me this far.

    Hi, technically the OR is allowed to access any information relating to your financial position regardless of who it is held by. If the ND dont want to give it, it will just take longer

  • To add, they do have to act mindfully to the human rights act

    The BR order overrides most rights to privacy, but only if it is relevant to there legal obligations, and in the interest of those concerned (or the general public)

    I have to admit, while i see why they may want the info, if they do smell a rat, if it is the same as you declared on your BR petition, that may be seen as a breach of your human rights, hence NDL's stance

    and of course if the information is anything other than financial in nature then it can be refused, or redacted to only show the financial bit

  • OR could be wanting to find out information because the CCCS gave you the wrong advice. I phoned the ND and i thought they where no good i could have spent a day on the phone and listen to there crap.

    Oregon I'm just going to add to the thread for new comers coming along for advice that I found national debtline really helpful and knowledgable. Each case is different/complex and of course everyone has differing views but they were an excellent resourse to me when I was at my all time low :)
