bank of scotland are making me go insane HELP!

i Signed a personal loan in branch 2 hours after getting home and reading the agreement properly i decided it wasnt right for me i phone to cancel it to be told theres not a cancelation period in branch but no one told me this or i would have taken it out over the phone as i have done this before and i know you have a 14 day cooling off period.....anyways the matter is in the hands of customer relations because they want£500 to cancel it treating it as an early settlement but im adiment its not an early settlement its a cancelation!!!!!:mad: Now they are telling me it can take 10 weeks to hear from customer relations by then the 1st payment is due i thought this would be frozen until this mess was sorted but im being advised that i have to pay it but surely if i pay it thats me entering the loan and it would then an early settlement!?!? I just want the loan cancelled the money is sitting waiting on them , i dont know what to do i feel as if im banging my head against a brick wall do i pay this 1st instalment or not do i HAVE to pay it, if i pay it is that me entering the loan ?*?*:confused:
I would appriciate anyone who could give me advice on where to turn and what to do

  • Doesn't sound right to me. I know when I took a loan out with HSBC a few years ago at my branch I still had a period of time when I could cancel. The rules might have changed I suppose. Did they say you had no right to cancel when you signed the forms at the branch?

    Legally you have no cooling off period as the agreement was signed in the branch. This is standard and they do not have to inform you as it is assumed that signing forms a contract unless otherwise stated. Your best bet is to just ask them to be reasonable and maybe negotiate on the settlemnt figure. If you do not make the first payment, it will probably go on your credit file as a default.
