Going to appeal

After a CSA **** up i am having to make a appeal.
Can anyone tell me how long this will take to get to the final outcome? Also,at the minute they say i have to pay off the arrears that i'm appeealing against.Is this right? If a appeal takes as long as most other things do with the CSA most or all of the money will be paid to them.

  • I don't think anyone can answer - it depends on your case and the level of complications that you have as well as the particular CSA office you are dealing with.

    You have to presume that you will lose at appeal (ie pay) if you are proven to be right in your appeal then they will repay you.

    Frustrating isn't the word, I know. You have my sympathy.

    Makes you really wonder is it worth even more time,hassle and effort.Maybe thats what the CSA hope?!

    I don't know what your appeal is about BUT if it is regarding arrears that you have accrued due to a CSA error then quite simply, you have to pay them. I'm in the same boat and frankly it's a national disgrace.

    Whatever you consider....do NOT try and appeal to the CSA employee on the other end of the phone because they will revel in you misfortune, they will make you regret the very thet that you were born....you are a only a sumbag NRP!

    I have arrears (COMPLETELY 100% DUE TO CSA MALADMINISTRATION) but, guess what????

    yep, you got it, I GOTTA PAY......................

    With regards to the OP question - you can ask the CSA for a copy of the booklet "How can I appeal against a child maintenance decision", isbn 1-84763-439-6. It will answer many of your questions. I believe it is on the CSA website too, you just need to dig a bit for it.

    In response to Royal Blues - We don't know your situation, however, if the mistakes (maladministration) has resulted in incorrect debt owing by you, you can appeal this which will then go tribunal where a decision is made on the facts of your case, and NOT by the CSA. The above booklet would be helpful to you too. If the CSA figures are correct, it likely won't be put through for appeal though (if it gets looked at by ICE)

    My ex has arrears also, which are as a result of the CSA not acting on my request to re-evaluate his payments after a specific change in his personal circumstance about 3 years ago. My request was in writing and so there is evidence at the CSA that I requested this. They didn't act, but he still has the arrears because the amount owing is correct, whether he likes it or not.

    I can understand that my ex will be LIVID when this goes legal (which is is now), but I would be very disappointed if the CSA didn't go after these arrears which are monies due to my child. (for her benefit)

    At the end of the day, it is up to BOTH parents (NRP and PWC) to inform the CSA of any change of circumstance which would/could affect the amount they have to pay. Maybe had my ex done this too, the CSA wouldn't have made this error and he would have paid the correct amount at that time.

    Royal - at the end of the day it will benefit your child, surely thats a good thing. Great Britian.....I do think so.
  • Sorry, I should have checked that before I sent. I meant the CSA would provide the facts, along with you and at appeal a decision is made outside of the jurisdiction of the CSA.

    It takes about 6 to 8 weeks depending on the Court Timetable!

    It can take longer the question you ask is really how long is a bit of string. I have had about 15 appeals and most of them have been upheld, and they say they dont make mistakes!!!! Really!!!!???
