ive recieved a letter from the CSA saying im now entitled to payments again of £30 a week starting from the 1st nov as my ex partner as come off benefits and is now working fulltime,it also states that there will be arrears paid.

what i need help with is when i was on WTC and worked pt i was entitled to the full amount, but now im on IS and have been for a year im not sure if i will lose the payments because with the arrears it comes to over £300 until may 2010.

could someone please explain to me how the system works.

You are entitled to the full regular maintenance but must declare to IS what you receive - you will lose £10pw IS (not sure if you have to declare the full £30pw or just the amount above £20pw).

For the arrears, if you have been on IS from the assessment date on your letter (it will say "£30pw from xx/xx/xxx" which will be an earlier datre than you actually begin receiving payments), then again you will lose £10pw for those past weeks of IS where CSA was due at £30pw. It appears you will not get all the arrears in one go, and will not get double for the number of missed weeks.
For the arrears I would declare 1/3 of the arrears element due - that way you get your £20 for those missed weeks and IS get back their £10.

i had to call the csa up about the payments as the last one i got was £1.25p in may of this year, and i got a letter through friday detiling the payments and arrears which are dated back to june this year

ok im a little thick when it comes to this as ive nvr had to declare this b4..so i need to call up IS and tell them the ammount im getting each week and i dont get what you mean about declare 1/3 of the arrears.

You should get a few more replies tomorrow. I wouldn't ring IS until you actually start receiving the money - they will reduce your IS immediately, and if your ex decides to ignore the csa schedule you then have a period of waiting for IS to reinstate your original claim (in other words you can end up with less money for a few weeks due to trusting that your ex will pay).

As I understood it, you have to declare everything to IS, but I know from past threads on here that IS don't always remember to allow you the £20 you were entitled to from June until now. The arrears of £30pw from June will be being paid as something silly like £9pw on top of the current £30pw - you are still entitled to 2/3 of these arrears (£20/£30 = 2/3). If the arrears are £9pw then divide by 3 and declare that.

no ive been awarded weekly payments of £30 and then the letter states from the 7-12-09 i will get £368 then the 7-1-10 i get £398 until 7-6-10..so its £122 and the rest is arrears..im sorry i know im a pain but i really dont understand things like this,i wish they would sort things like this out instead of people having to do it thereselfs to save on confusion
