    So this only applies if the average pay is below the standard rate - ie if your employer pays more than the statutory minimum, they do not have to re-calculate?

    The recalculation would always need to be done on the first six weeks' payment of SMP, that is the 90% average payment. If it was the case that this 90% figure was below the SMP lower rate paid for the rest of the time, and so was being paid throughout the leave then the recalculated figure would apply throughout the leave. As I said before this may have to be done more than once during a maternity leave.
