david lloyd can't afford to pay

my husband signed up for a joint membership(for us both) for david lloyd gym in march 09. since august he has not been getting paid by one of his main customers and cannot afford to meet all his financial obligations.
the outstanding amount has now risen to £480 and they are sending chasing letters to us. the last one said they will send him to debt collection agency (arc europe ltd).
i am wondering if anyone has any advice on the following plan:
i have my share of the outstanding amount and was thinking of send them an SOA with a full and final offer of £240.
the problem i can see is that we are within our initial 12 month period. i think it is just my husband who is liable for the debt as it is all in his name and he signed the agreement.
i know we should morally pay this debt but he has much bigger fish to fry than a gym membership. we have not had use of the facilities since july 2009/

It may of been better to contact them when you realised you wouldn't of been able to make the payments, I would discuss with them about not having used it and see if they will accept the payment you have. Thing is gym's bank of ppl just paying and not using the facilities.

my husband did ring them and tried to get them to suspend the membership for a couple of months but they were having none of it.
i think i will try writing to them and see what happens.0 -

Good idea, if you can send it recorded delivery (think it's about an extra 70p) so you have proof that they have received it!was Proud to be dealing with debt! thanks for the help.
will see what hubby thinks of the idea later- i have written the letter so fingers crossed he agrees to sending it and they agree to accepting the offer.0 -
Just to raise a point, you say it was joint membership, in which case i assume there i just one contract.
This would mean you are both liable for the full amount, legally there is no such thing as paying your 1/2, if a full and final settlement is agreed on the debt, then your OH wouldn't be liable for the remainder as the debt as a whole would be settled.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0
