Problem with the car??

Morning All,

I have a question.....

I recently sold my car (for market value) and brought another car, now my husband delt with the buying of the new car and for some unknown reason didn't listen to me when I said "make sure its in my name".

So receievd the log book today and guess what... Its in his name.
That means he now has 2 cars in his name and none in mine.
We are both planning on going BR - just filling in the forms.

So my question is... Shall I get the car transfered to my name? It was the money from the sale of my old car used for it.
Or does it matter that he has 2 in his name? We both need cars for work as we work about 20 miles in the opporsite direction.

Really worried about this as we can't afford to loose a car or buy back the BI as neither car is work more than £1000 but would be together - sorry i'm rambling now.

Anyways, thanks in advance for any advice

  • Firstly, it is more important you check your insurance is valid, some insurers dont care who it is registered too, others do, and it can void your insurance, in theory.

    Secondly, as the V5 does not prove ownership it does not matter, although the OR, wrongly in my view, will see it that way, so you will need to prove you funded the purchase, and if possable a reciept in your name to prove it is yours

  • I would need to change the insuracne as I said i was the owner & keeper.
    The receipt is in his name as he actually handed the cash over.
    do you think it would look bad if I changed it into my name?? i so worried now
  • In theory if you put it down on the forms as your property, you are making a sworn statemant that it is before the court.

    Ownership is a difficult area, as you can swer its yours in all honasty, and the OR may not question it any further.

    But if they do and you produce a reciept in his name, rightly or wrongly, the OR will sieze the oppertunaty to get some money out of you.:rolleyes:

    Can you show the car/funds came from you?, if so ,and if asked, just use that as proof.

    But in the mean time, getting the log book in your name is fine, as i said it has nothing to do with ownership, so you are not changing who owns it.

    Unfortunatly some examiners dont seem to understand that and may see it as an attempt to hide an asset:confused:

    hi...simply send off the V5c to DVLA, changing the name.
    I suppose your OH would need to give you a receipt for the cash you gave him for the car????


    In the end, a receipt is simply a piece of paper..[unless you bought from a dealer?] so will hardly bear up to scrutiny.....which is probably why some OR's prefer to see the V5c?

    IN the end, it could be deemed, under 'joint' ownership, as you are married?
    [to be pedantic?]...so simply getting the name changed on the V5c really is hte only way of confirming ownership?
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    Both my and mt OH's car were in my name when we went BR, it wasn't a problem for our OR at all, she could see we both needed cars for work and exempted both.

    Another useful tip, if you do decide to change it to your name do not use the 'change of owner' part of the form, otherwise it'll add another owner to the car. Write to DVLA explaining that the garage made a mistake and they'll change it to your name without adding another owner.

    I think I will do as Peachyprice suggested and write DVLA a letter, we brought the car from a local trader so i might ask if he will re-issue the receipt in my name.
    Gosh it all gets quite complicated this BR stuff - thank goodness for all you experts :)

    If the car is not worth that much I would just send the V5 back with change of ownership. It will add an extra owner to the list but will make no differance on that cost of car. Won't cost you anything to do it other than a stamp!
