i think creds/banks/dcas could come under serious crap for chasing a debt after discharge particularly if its in the br petition as they would be trying to by pass something which has been laid down in a court of law.especially if you can get a letter from the insolvency service
stating a full list of creditors who have been informed by them,i myself are up for discharge next mth and dont intend to take any crap from any of em especially the ones who begin with N.0 -
i think the original creditor has a liabilty to inform all dcas who they first employed to chase the debt listed in the br also to the ones they may have sold the debt to, ijust think the greedy sods in the banks/dcas etc are trying to do a double whammy get some cash from the br estate if they have made a claim and after the bankrupt has got discharged try heir luck again with him/her hoping they have the iq of a mouse:D
i am up for auto discharge in 4 wks :beer::beer:and will really set to work updating my cred ref files i have the letters from hell 4 em if they try bugging me ever again and i also have the time to drag em into court would brighten up my day;)0 -
interesting idea blindas a bat i have two company st credit and wescot for well over years continuing ringing me up ,. leaving message and sending letter asking demand .. .
when i complained to my Or about this increasing threat and demand . My Or send me a letter back stating they were informed in writing of my BR 5 weeks or so ( they gave me an exxact date ) after my BR order and told me to contact them telling them that they are aware of this creditor report but they refuse to stop collecting. so does it mean that the Or gave me the oK to probably take action against them or warn them?BSC number 1830 -

They certainly gave you all the ammunition you needed, and you have the right to warn them regardless, as for taking action, if they are stepping over the line and acting criminally, yes you could, I am just not sure what the best route would be yet, would the police be intrested if you tried reporting it?.Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….0 -
I am just not sure what the best route would be yet, would the police be intrested if you tried reporting it?.
If the action of a DCA is actually ''criminal'', then yes, the police will help..but if the offence is a 'civil' matter, the police are powerless to assist.
I am dearly wishing one of my ex-DCA's will start up again...especially if they carry out a threat of a personal visit.
Around here, the area has a 'no cold-calling' policy, with the LA taking action against such people...as far as I would be concerned, I haven't been warned, so a visit would be a 'cold call'........let them argue their way out of that one?No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
