Been refused information about my default after CCA Request

Hi there,

I have a default on a credit card which defaulted in 2005. it was settled in 2006.

Basically my Fiance! and i want a mortgage and this is stopping us.

Having done a bit of research i sent a CCA request to RBS/Natwest for the default notice as i have no information about the default as it was so long a go and for less than £1000 so can't remember much about it. Had been researching and thought there maybe a possibility that they may have no info on it anymore so i could challenge the necessity of the default and maybe get it removed, or failing that if they did still have all the info then i could take it from there and see what my options were.

the letter i got back said;

"Your request for documents contains some misconceptions about your entitlement to information in a specified form and our obligations to supply that information"

"this is no longer an active creditcard account. The consumer Credit Act is for active agreements and therefore we are under no obligation to provide you with the requested documents as you request under section 78 (1) as the agreement on this account has ended"

Would you be able to tell me where i go from here?

I want to try and get my info - am i entitled to ask for it?

is there another 'act' which i can request it under?

Any help is massively appreciated and sorry if i have missed off any info, please ask if you need more details, i'm new to this so have added everything i can think of.

    I think you need to quote the data protection act to them which entitles you to ask for any and all information they hold on you. But double check first as not 100% certain.

    Also, have you looked at your credit file. Info should be on there too...I think. :)

    You need to make a Subject Access Request in writing or email.(SAR) has fees to comply with so the (SAR) gets done to satisfactory standards.
    Untill the fee has been received they do not need to comply with the request.
    This is not me saying this.
    The law states this.
    Company's do not like complying with these requests.
    I know as I have made a few recently.
    You need to make a (SAR) under the data protection act 2002 section 5.
    You may want to do some research in to making these sorts of requests as the company's lie and always will do.
    But the law is set in stone as not many of us know of these laws company's break these and get off lightly.
    You can also request the (SAR) under the freedom of information act 2000.
    As long as these company's have our information about ourselves.
    We will always have the right to request information held manually or on a computer.
    As we need to exercise our human rights.
    Wether we are customers or previous customers.
    If they have our information about ourselves we have the right to make these requests under the (Human Rights Act) and always will do regardless.

    Welfare Rights helped me out.
    Now I pay a little amount each month to clear debt.
