Advice re: completing the court fee exemption form (EX160)

Hi all,
I'm actually posting this request on behalf of my mother, who's not too net savvy.
Currently going through the EX160 and Section 3 makes mention of receipt of benefits. Now, my mother is in receipt of Incapacity Benefit (as a result of a nasty car accident a couple of years back) but it's not listed. HOWEVER, Employment and Support Allowance (ESA) is (IB is the same thing in all but name - info on DirectGov website - and recipients are to be 'switched' to the 'new' benefit sometime between 2010 and 2013).
My question is: would it be incorrect of my mother to tick ESA on the form or would it be better to state she's not in receipt of ESA and fill out the details in Section 4??
I hope that makes sense!

Incapacity and ESA are not the same thing, although really similar!! ESA is more about "testing" you to see if you are really ill and getting you back into work.
If IB is not mentioned, then she cannot claim for that benefit. Also she would need proof and the court would not accept it as its not on the list.
If she is on IB though, she can still claim under the low income rules, because she is.0 -
