    apples, actually i dont, the reason i was off sick was because i have been bullied, hit and harrassed at home by my manager... im now looking at losing my house in 10 days because she decided not to inform payroll i was off sick so i havent had any SSP, and as such have had to live on my £20 a week child benfit...

    im not looking for explanation and rationale i was actually looking for some legal script or some sensible advise as to whether i might have some information to at least bargin the trustess with...

    You have no idea how much my daughter loves that nursery and how much i love all the staff there..

    But unfourtunatly because its a charity the trustess are going over the nurseries head.

    Lauren. If you have been hit by your manager then you need to file a report of assault with the police.

    Now, onto the subject of the nursery, you need to look at the full terms and conditions and not just the 'fees' section. Sit down and have a good read of what it is you have signed. I can't believe that they wouldn't put it in there somewhere. Before you write a letter back, call them up and say that you are confused; and could they tell you where in the contract it says that if the child is not there, then the fees still have to be paid. Act a bit dim and see what they do.

    the T&C state, the only time you dont have to pay, is when you use your 'holiday period'

    to me that means, you pay for all sessions other than those taken as holiday - it couldnt be any clearer

    your full T&C should state how long a 'holiday period' is

    Hi,the first thing you have to do is to meet the problem head on.i know you are not well,but the problem has to be dealt.Organise a meeting with the nursery manager and explain your side of the story to her and how you feel.If it is not stipulated in contract that you have to pay when your little girl is home with you,then you have a fair point.But i hope you have informed nursery during the time that you were off work,that daughter is going to be home with you.Most nurseries charge wheather or the child attends.But still arrange the meeting and talk to them.They might agree to reduce the fees,might still withdraw the place for your little girl. If they do make this offer,i would accept it and look for a childminder-which is a much cheaper alternative.With childminder you can talk above contract and tailor it according to you needs-eg,not paying childminder on parent's occasional sick leave.

    I don't know your circumstances,but are you eliglible for tax credits and top up income. Try and take the day as it comes and deal with problems one by one.secure a place for childcare for you little one b4 moving on.After you have done this,try and apply for other jobs,cos i wouldn't be working for your employer if i was treated like that.Or try and sort it with your union.take care

    you only get SSP by providing your employer with a Drs Note - your manager passing on that you are ill, doesnt constitute the terms of SSP, so the reason you havent been paid, is because you havent provided the correct paperwork

    i know, your head probably isnt in the right place to think about all the legalities you need to go through at the moment, to sort out nursery/SSP, but unfortunately, the onus is on you to do all the chasing around, if you want this sorted

    as for your manager assulting you, i wouldnt be moaning about them not passing details onto payroll, i would be straight onto the Police

    How come you only have child benefit, are you not claiming tax credits too? with the amount you pay out in childcare, this should be the next thing on your agenda to get sorted

    as for work its being dealt with, the manger has been removed from our branch, and i was providing drs notes throughout my sickness, she wasnt informing payroll! my office are trying to sort this out for me.

    I dont want to remove DD from nursery its so expensive because its the best around this area.

    I am also happy to pay the fees but i was rushed into hospital with suspected TIA's currently looking at a diagnosis of somewhere between very strange migranes (because there is no headache) and a brain tumor!

    I'm a week behind on my £250 payments ive just realised re-reading the letter from the trustee's because of being in hospital i didnt pay on the week beginning 19th and havent paid this week beginning the 26th (i usually pay on a wednesday tax credit day so i should of paid today but because of the surprise of this letter i forgot to give them a cheque!) and they also want the money for the beginning of november by the looks of it? im not 100% sure...

    The nursery is wonderful and so are the staff, My DD has come on leaps and bounds since starting there, she was advanced anyway but the quickness of her development has been amazing to see...

    I know the assumption is that you pay wether they are there or not, its not that im trying to get out of paying, im just trying to buy some time to wait for work to sort me out some of the money ive not been paid if that makes sense?!

    I didnt make myself very clear earlier as i was upset and stressed, I'm 21 weeks pregnant too and look to be losing everything and in my current health state its putting me and my baby at risk...

    I've come off income support and tried so hard to set up something decent for my DD and it just feels like its not worth the effort! im worse off than being on IS anyway!

    I'm writing them a letter and will take in a cheque for £250 tomorrow, they knwo ive been into hospital but they dont know why.. maybe the sympathy vote might get me another week to pay it off..

    I'll also let them see my last 2 wage slips, but i will also mention that it was never made clear to me by the nursery or in any contract that i would have to pay for her time when she is not there.. Its nots clear in anything they have provided for me to sign.

  • Take a deep breath, exhale, take another deep breath and exhale.

    Now that you've calmed down abit you really do need to sort this out with the nursery - and getting all worked up is not the right way to do it.

    Generally speaking if your DD isn't at nursery and she's due in and its not a pre-booked holiday then yes, you do have to pay the fees.

    However they have probably sent you the letter as it would appear from their point of view that you have not stuck to your agreement - yes I know you were ill but they don't know / don't care because its not their problem.

    You need to get in touch with them - with a cheque for the missed payments - and explain the reason for the non payment of the installments. I would also, in the letter, promise to set up a standing order for the remainer of the installments - at least it shows willing.

    If work hasn't paid you you need to get onto HR immediately and explain that the delay in paying you has caused severe financial hardship / embarrasment and that you need an interim payment to made.

    Your personal situation is really irrelevent when it comes down to it legally.

    You owe the nursery this money and they are perfectly entitled to demand immediate payment of all dues - unless the terms state otherwise which they dont appear too.

    I would suggest you pay if you can or speak to the nursery committee and fully explain the situation. If it is a charity I am sure they have funds and procedures for this sort of situation.

    Getting on your high horse or trying to get out of paying what you owe because you didnt send her on days you should have will not endear yourself to them though.

    I am suprised that if your manajer hit/attacked you, they didn't carry on paying you full pay..?.

    They were going to pay me something to stop me taking it to a tribunal which today i found out is £50...

    And ive been sent home from work for 2 days on full pay :confused:

    It will probably be better for my family if it turns out i do have a brain tumor and just randomly drop dead at some point...

    I wonder if my manager clouting me round the back of the head would of caused it to become un-dormant...

    Going to see if my boyfriend will consider selling his Wii and my games to put towards the fees and ill sell my mobile, and buy him a new black wii thingy for xmas...

    Thanks for everyones advice ive sent in a letter to nursery and a cheque for this weeks fees, just got to see how we go i guess! will see if i can get a crisis loan from the jobcentre or something now i have time to try adn sort it out.
