    The OP's stated "car used for work" so that would be classed as a tool of the trade so doubt the OR's would touch...no car no work no possibility of an IPA

    Thanks Phil. Just for future reference, do the OR's usually allow people to keep a car which they will need for work even if they are out of work and looking at the time?

    Fingers crossed for the OP then. At least the OP's parents are in the position to make an offer to the OR for the car if it comes to it.

  • I know a bloke who went BR and his £2k car was exempt as he needed it to 'look for work'
    Myself, i had to pay the trustee £500 to keep the car even though without it i would have lost my job, my car was valued at 1.5k, even if you have to buy the interest back make them a low offer.
    As you have been told already no two OR's are the same as proven by my situation.. good luck.

  • I have an old astra eastate car, I told the OR that it was valued at £300.00. I was asked how i came to that amount, and told them about age, condition etc, but they still said they may have to take it as it was not used for work (remember the cost of running a car is monie to them if you dont have one) They got back to me later about taking the car, and i told them that as we lived in a village, we needed it to take our pentioner mother in laws shopping, as well as our own. I also told them that i used it for un paid pest control work, ie ferreting and farmers relide on me, and they let me keep it.

    As others have said, there can be a lot of variance between one OR and the other, but, if it essential for work or to run a business, it is more likely to be exempt than not, especially at that value.

    The important thing is to be absolutely accurate with explaining your status. If you are out of work and claiming JSA, then you would need to persaude the OR that the occupations you are suited for would require you to have a vehicle. However, if you are a self employed ceiling fixer you simply hasn't got any "jobs" on at the moment, this doesn't necessarily mean you are out of work. If you were still giving quotes and looking for contracts, then you may still be classed as in employment :)

    I haven't done any ceiling fixing work now for over a year and I am no longer self employed. I was employed under paye recently but have been given notice again through lack of work and my last work date will be 31st October 2009, after which I will need to sign on again as unemployed. I am not ruling out ceiling fixing in the future when the building trade picks up but I will take any job at the moment so I'm not sure how I can explain to the OR that I need the car for work?

    Hi again seh567,

    I'd just explain to the OR at interview that you are looking for work and will need your car when you find work (or maybe even to get to interviews etc depending on where you live and public transport etc?) Is there any other argument you can state for 'needing' the car, as opposed to 'wanting to keep it'?

    As we said before, if this fails and your OR declares an interest in the car, then your parents will be able to make an offer to him for it.
