Can anyone help, voluntary returning a car and your credit score??

Hi can anyone help, hope I've posted this ok im a newbie, apologies if not.

We have just return our car after paying more than the said amount in the terms and conditions, after a bit of messing about and Carlyle Finance saying our letter had been lost etc, we recieved a letter saying we owed £0.00 and after a RAC inspection the car was in excellent condition and could be returned, it was collected by an auctionhouse beginning of this month.
So all was fine then I checked my Credit Expert account and had a late payment against my name, on phoning Carlyle I was told that my credit files will not be corrected till the car is sold at auction !!!!!!!!!!
They eventually said they would correct it, they did but only to a non late payment, it stills shows owing of £6700 and not a VT like it should.
Now my husband returned a car before some 7 years ago and I know it shows as Voluntary Termination and amount owing £0.00 and should be done as soon as possible.
So I rang them again and they stated they will not rectify the credit file till its sold at auction, now this car is no longer in my name, DVLA have confirmed this and I have 3 seperate letters confirming I have zero liability to this car and no where in the terms and conditions does it state it has to be sold at auction. I feel im being treated as if its a repo and not a voluntary termination.
Please help does anyone know if this is legal and what I can do, sorry for the long winded thread im just so annoyed companys are supposed to be helping people in these hard times and not being rude and unhelpful on the phone. :mad:

    When I recently looked at my credit file, it was showing that an old loan had an outstanding balance, no default etc, just an outstanding balance. I contacted the head office of the loan company, they told me that they have standard forms for experian etc, so if any changes are necessary, it really is as simple as filling in a form and faxing it through. It took only two days to have the loan balance removed from my file.

    I would most certainly persist with this matter. Speak to head office wherever possible and ask them to point out where it says in the terms and conditions that the voluntary termination is not complete until the car is resold. Also tell them that if your good credit is ruined because of this, you will take legal action against them claiming compensation etc.... I have used that one before and its surprising how quickly they can act lol.

  • Thanks so much, Experian are on to it as we speak, but it concerns me that they are not the only credit file keepers, if Experian are corrected, are all the others ???
    Thanks again, husband is ringing FSA today and Carlyle are on there list of companies that are regulated so hopefully can shed some light.
