I would change some of the phrasing...
"I refer to section 13.13 of the Banking Code. From the website at http://www.bankingcode.org.uk/supportlist.htm, I note you have subscribed to the code.
Section 13.13 states
If you are in difficulties, you can also get help and advice from debt counselling organisations. We will tell you where you can get free money advice. If you ask us to, we will work with debt counselling organisations such as Citizens Advice Bureaux, Money advice centres, or the Consumer Credit Counselling Service.
I once again advise you that I am working with CCCS due to financial difficulties, and formally request that you work with them.
This would replace the section starting "I would just like to point out".. to "going to court."
I would also enclose a copy and an SAE, asking them to sign and date the copy before returning it to you, to confirm that hey have recieved it. That won't achieve anything in itself, but it's a subtle sign that you are gathering evidence against them.
Just IMHO, feel free to accept or reject.Debt free 4th April 2007.

Dear Sir or Madam:
I am writing in reference to the previous letters you keep sending me demanding more money, you are aware of our financial circumstances, but yet you feel obliged to harass us either by phone or mail. Please to clarify things we are on a DMP with CCCS we have not missed any payments to you and have paid an amount based on original repayment scheme (this is devised by CCCS).
We have written, as have CCCS requesting all interest to be stopped, however interest is still being added on in some cases in over 400% more than the payment being made.

I once again advise you that we are working with CCCS due to financial difficulties, and formally request that you work with them. We have done our part by offering payment that we can afford. We are in a position to increase the payments from July 1st, but yet you still continue to send threatening harassing letters. Should we go to court and we are forced into bankruptcy the chances of you getting the outstanding debt are unlikely this would result in a costly outcome, and result in bad publicity for HSBC. We could file for bankruptcy and walk away from this horrible situation, but we know the debt is ours to repay therefore we will repay it how ever long it may take.
Please could you forward details of your complaints department, so that i can make a formal complaint about the bad handling on you part, also for the appalling way which we are being treated. If this matter is not dealt with satisfactorily we will be making a complaint through the Financial Ombudsman service. We will also be asking for the excessive interest charges to be re-credited
As already expresse we are paying the amount we can afford to pay, we will shortly reach a point where we are able to increase payment which we will do on 1st July 2006so we ask you again please consider what you can do to ease this difficult situation.

We have sought advice and your resistance to help and unnecessary actions are only adding to the amount of debt which we will be contesting in court.
I wouldn't use this phrase. There is an in built assumtion you will be going to court. Actually I'd take out all of that sentence and the next one. They might make you feel better but I don't think they'll help your cause.
At such time we will be making the court fully aware that we have made every attempt possible to repay our debt and it is only your greed and obstinence, from yourselves, against the Bankers Code of Practice which you should be following that has brought about this unfortunate situation
And calling them greedy ain't gonna get them on your side. You catch more flies with honey than vinegar. Try and keep emotional phrases out of it.

Kicking Kay - I'm sorry to hear you're having a worrying time.
Just one thought as I was reading the thread - are you breaching your contract with CCCS if you contact HSBC yourself? I'm doing my own DMP, so don't understand the contract with CCCS, but I'm sure I've read on other threads that you need to refer all these matters to them.
In my experience, I've received one default notice from one company. I agree with Emmzi's suggestion that the default notice may have been issued to cover themselves in the event that you don't pay in the future.
