Arrears payback

Hi, can someone remind me of the law regarding paying back CSA arrears please?
My partner has been paying extra on top of his regular maintenance payments but recently the CSA have written telling him that they will now be taking the money directly from his wages and instead of £15 a week for arrears they will now be taking almost £100 a week extra. Which we obviously cant afford.
I think I'm right in saying that CSA legislation recommends arrears should be paid back over two years but that there is no law to enforce this? I want to write them a strongly worded letter but need to know where i stand first.

No there is no law but there is a directive from senior management - your only hope is to do this via your MP and ICE etc. HOw much is there still to go?0

When we got a breakdown of his arrears (after asking four times!) he owed approx £4000. He got a letter earlier this year sayinh he had over paid by £400 and this would be taken off his arrears (as well as paying £15 a week towards his arrears). Originally they asked for £10 a week in arrears then went up to £15 both of which he agreed to but there was never any mention of a timescale to pay them off. |Now all of a sudden he gets a letter showing that he has to pay almost £100 a week arrears and then they will be paid in under a year.
To be honest i would prefer to get it paid off asap as I hate either of us being in debt but there is no way he can afford that much.0 -
Why did the arrears accrue in this first place?
If they occured as a result of some kind of incompetance on the part of the CSA, then you could complain that this was a result of maladminstration. If found to the case they will deal with your arrears more sympathticly.
If however the arrears are because of a deliberate failure to pay then I hope they make your life a misery in trying to recoup them!When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.0 -

I actually agree Borders - if an NRP has DELIBERATELY avoided paying then of course they should have the book thrown at them!0

I agree Borders is technically right - just could have worded that sentence a lot better, eg If you knew you were being assessed/reassessed, you should have made some kind of guess as to what it may be and put extra aside.0
